<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 14, 1993 <br /> <br />Page 7 <br /> <br />Public HearinCl. continued <br /> <br />City Planner Erny Mattila presented a request to exempt a proposed <br />remediation facility from the Moratorium Ordinance on contaminated sites. <br /> <br />Bell Lumber and Pole applied for site plan review to construct a remediation <br />facility which will contain water treatment equipment for the CROW <br />(Contained Recovery of Oily Wastel process, the off-site groundwater <br />plume control wells, and the wood-treating plant. <br /> <br />A section of the Moratorium Ordinance allows Council to exempt <br />remediation projects from the ordinance restrictions if it is determined after <br />a public hearing that the project is intended for remediation purposes. The <br />criteria used to make such a determination is: proposal complies with all <br />provisions of the City Code; proposal is necessary or expedient to effect <br />remediation or to delay or prevent release of hazardous substances; and the <br />proposal is part of an approved action plan by the MPCA or the EPA. <br /> <br />The Bell Lumber proposal appears to qualify as a remediation project. If the <br />project is exempted from the ordinance, the proposal will be considered by <br />the Planning Commission and later by Council on September 28. Mattila <br />reviewed the building plans with Council. <br /> <br />Williams asked if this request is an expansion of the use for the site. <br />LeFevere noted that the agenda item merely opens the door for the Type IV <br />non-conforming use application process. The Planning Commission and <br />Council would eventually review this project later this month. LeFevere <br />said it is necessary to request an exemption from the ordinance before it is <br />brought before the Planning Commission. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Larson, seconded by Rebelein, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 9: 15 p.m. <br /> <br />Motion by Benke, seconded by Larson, to EXEMPT THE PROPOSED <br />REMEDIATION PROJECT FOR THE BELL LUMBER AND POLE SITE FROM <br />THE MORATORIUM ORDINANCE ON CONTAMINATED SITES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public HearinCl - Vacation of Old Highway 8 Right-of-Way - 9: 16-9:30 p.m. <br /> <br />Mattila presented the vacation of a portion of the Old Highway 8 right-of- <br />way adjacent to the former Robinson Coach site. <br /> <br />The portion of the right-of-way was originally owned by the State which <br />then deeded it to Ramsey County when Old Hwy 8 became a County road. <br />In 1987, the City staff approached the County about the states of the right- <br />of-way.
