Her son was the child hit by the car. <br /> <br />Benke and Larson support the barricade removal. <br /> <br />Rebelein would not endorse the removal of the barricade because it would <br />be a temporary solution. <br /> <br />Gunderman feels a decision to remove the median is premature before <br />receipt of the staff findings on May 11. <br /> <br />Williams agrees with Rebelein and Gunderman. <br /> <br />Motion by Benke, seconded by Williams, to TABLE THE ISSUE OF <br />REMOVING THE BARRICADE ON 8TH STREET UNTIL THE EXAMINATION <br />OF THE STAFF REPORT REGARDING THE SIGNAL PLAN TO BE <br />PRESENTED ON MAY 1 1 . <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila said Council directed staff to prepare resolutions to deny the special <br />use permit for Church Upon the Rock to locate in the Rice Creek Shopping <br />Center. <br /> <br />On April 23, staff received word that the Church had withdrawn their <br />request. At that same time, staff received the Church consultant's, the <br />Guidera Group, Inc., analysis of the McComb report. <br /> <br />Council has two options, either accept the letter of withdrawal or <br />acknowledge the letter and take action on the Special Use Permit. <br /> <br />Church Upon the Rock representatives were not in attendance. <br /> <br />Benke feels the Church has had significant time to respond, and after <br />reading their analysis, he does not question Council's decision to prepare <br />the denial of the permit. In fairness to the Church and recognition that the <br />Center's tenants are under duress, it is best to conclude the matter. <br /> <br />City Attorney LeFevere said in order for Council to develop the best <br />possible decision, Mr. McComb was asked to analysis the Guidera Report. <br /> <br />Mr. McComb said the Guidera report examined four shopping centers which <br />where churches are located. He has visited the Prudential Center, ARCO <br />Plaza and Bergan Mall, but not North Shore Center. All are regional malls <br />with significant different designs than the Rice Creek Center. North Shore <br />Center has over 1.6 million sq. ft. of commercial space and a chapel <br />occupies 10,000 sq. ft. He was unaware of a church in the Prudential <br />Center, but the directory listed a chapel. Bergan Mall has a 3,000 sq. ft. <br />chapel.
