Mr. McComb feels this statement is unbelievable based on the average family income. Benke said it appears the Guidera Report examples are out of date and much smaller in scale than what the Church has proposed. Williams appreciates Mr. McComb's analysis given the short notice. He is willing to take action based on the McComb report and it's analysis of the Guidera Report. He feels the tenants are being held in limbo. Motion by Williams, seconded by Rebelein, to WAIVE THE READING AND ADOPT THE RESOLUTIONS DENYING Sp.172A AND APPROVING SP. 172B, SUBJECT TO CONDITIONS. 5 Ayes - 0 Nayes, Motion Carried Jean Smith, resident, noted that some of the Center's businesses have experienced substantial water damage from a leaky roof. Benke said Council is aware of the problem and staff will investigate. Dave Ulrich, Spectacle Shop, is attempting to locate a travel agency in the Center. His partners were contacted by a Church representative who said they are not in favor of the travel agency because of Ulrich's involvement. He was approached by Church representative and asked to not attend tonight's meeting, and also the Pizza Factory owner received similar communications. Some of his clients are Church members and have said they do not favor the Church plan and will not fund the project. Williams feels that New Brighton citizens should not feel guilty about exercising their First Amendment rights in this Council Chambers, and he does not doubt the accuracy of Ulrich's statement. Stan Smith, Citizen Study Committee CCSC), said the CSC was directed to assess the penalties for tobacco sales to minors, cigarette vending machines, and New Brighton's goal to discourage smoking by residents. CSC recommends that existing State laws and City ordinance be enforced to provide ample deterrence to shop owners. The new license requirements would be funded through a Council approved investigative fund, and those monies be used to enforce existing law and ordinances. The group noted that the removal of vending machines may introduce disincentive for businesses to operate locally, and potentially drive incremental business to surrounding communities. The committee recommends using education and awareness as the means to reduce tobacco use.
