Mr. McComb <br />feels this statement is unbelievable based on the average family income. <br /> <br />Benke said it appears the Guidera Report examples are out of date and <br />much smaller in scale than what the Church has proposed. <br /> <br />Williams appreciates Mr. McComb's analysis given the short notice. He is <br />willing to take action based on the McComb report and it's analysis of the <br />Guidera Report. He feels the tenants are being held in limbo. <br /> <br />Motion by Williams, seconded by Rebelein, to WAIVE THE READING AND <br />ADOPT THE RESOLUTIONS DENYING Sp.172A AND APPROVING SP. <br />172B, SUBJECT TO CONDITIONS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Jean Smith, resident, noted that some of the Center's businesses have <br />experienced substantial water damage from a leaky roof. Benke said <br />Council is aware of the problem and staff will investigate. <br /> <br />Dave Ulrich, Spectacle Shop, is attempting to locate a travel agency in the <br />Center. His partners were contacted by a Church representative who said <br />they are not in favor of the travel agency because of Ulrich's involvement. <br />He was approached by Church representative and asked to not attend <br />tonight's meeting, and also the Pizza Factory owner received similar <br />communications. Some of his clients are Church members and have said <br />they do not favor the Church plan and will not fund the project. <br /> <br />Williams feels that New Brighton citizens should not feel guilty about <br />exercising their First Amendment rights in this Council Chambers, and he <br />does not doubt the accuracy of Ulrich's statement. <br /> <br />Stan Smith, Citizen Study Committee CCSC), said the CSC was directed to <br />assess the penalties for tobacco sales to minors, cigarette vending <br />machines, and New Brighton's goal to discourage smoking by residents. <br /> <br />CSC recommends that existing State laws and City ordinance be enforced <br />to provide ample deterrence to shop owners. The new license requirements <br />would be funded through a Council approved investigative fund, and those <br />monies be used to enforce existing law and ordinances. <br /> <br />The group noted that the removal of vending machines may introduce <br />disincentive for businesses to operate locally, and potentially drive <br />incremental business to surrounding communities. <br /> <br />The committee recommends using education and awareness as the means <br />to reduce tobacco use. <br /> <br />Council Business <br /> <br />Church Upon the <br />Rock <br />Report 93-120 <br />Resolution 93-062 <br />Resolution 93-063 <br /> <br />CSC Tobacco Study <br />Report 93-1 21 <br />
