Smith said Police Chief Kelley's recommendation was for <br />a $250 increase in licensing fees to provide funding for periodic stings. <br /> <br />Smith said progressive penalties will be used. The first violation will result <br />in a 3 day suspension, second violation a 30 day suspension, and third <br />violation could result in revocation of the license. <br /> <br />Nelson Hard, ese, said enforcement may involve license revocation and a <br />misdemeanor charge against the clerk who sold the cigarettes. Because <br />store owners have trained their employees of the law, CSC recommends <br />duV"penalties, against the owner and the employee who sold the product. <br /> <br />LeFevere said State law charges a misdemeanor to the clerk who sold the <br />product. If Council prefers, the City Code could provide for du~ penalties. <br /> <br />Benke said if effort is spend enforcing the ordinance, sales to minors would <br />reflect the State law and City Code would enforce the license holder. <br /> <br />Rebelein said the ultimate goal is to stop the sales to minors and it makes <br />sense to prosecute the clerk who sold the cigarettes. <br /> <br />Larson thanked the CSC for their report. <br /> <br />Motion by Gunderman, seconded by Larson, to ACCEPT THE <br />RECOMMENDATIONS OF THE CITIZEN STUDY COMMISSION RELATING <br />TO THE REDUCTION/ELlMINA TION OF SMOKING AND THE USE OF <br />TOBACCO PRODUCTS IN NEW BRIGHTON. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Proper presented the Environmental Quality Commission recommendation <br />for the addition of magazines and junk mail to the curbside recycling <br />program effective January 1, 1994. <br /> <br />The annual increase in recycling tonnage for each stream is 3%, with a <br />surge of 5% for the first three months. With an average tonnage of 1,440 <br />tons/year, the additional tonnage will cost each homeowner $ 1.43. The <br />recycling portion of the 1992 property tax is $15.40. The new rate would <br />be about $16.83. City Sanitarian Dave Fridgen will prepare an additional <br />report for Council. <br /> <br />Motion by Rebelein, seconded by Gunderman, to TABLE THE ADDITION OF <br />MAGAZINES AND JUNK MAIL TO THE CURBSIDE RECYCLING PROGRAM <br />EFFECTIVE JANUARY 1, 1994. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Williams asked if the effective date could be moved to July 1, 1994. <br />Proper will ask Fridgen. <br /> <br />Council Business <br /> <br />CSC Tobacco Study <br />Report 93-121 <br /> <br />Magazine & <br />Cardboard Recycling <br />Report 93-122 <br />
