<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />March 23, 1993 <br /> <br />Page 8 <br /> <br />Public Hearing. continued <br /> <br />Motion by Rebelein, seconded by Larson, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 9: 11 p.m. <br /> <br />Motion by Rebelein, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVE PL-203. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Manager David Childs presented an appeal for partial or full payment of <br />a frozen water service claim from Guy Schoonover, 2257 Oriole lane. <br /> <br />City policy provides that each winter when frost reaches a certain depth, <br />the City will notify homeowners who have had previous freeze-ups. Since <br />there has not been any past freeze-ups at Mr. Schoonover's address, no <br />notice was sent. Such a notice will be sent in future years. The policy <br />allows the homeowner to appeal the City Engineer decision to Council. Mr. <br />Schoonover is appealing for payment of part or all of the $150 bill. <br /> <br />Childs clarified that the problem occurred at the water pipe which runs <br />between the stop box and the watermain outside the property line. He <br />noted that the last appeal the City received was about four years ago. <br /> <br />Benke feels that given the rarity of such a problem, the appeal should be <br />approved. He suggested the modification of the City Code which would <br />allow the City Manager to approve or deny appeals. <br /> <br />Mr. Schoonover asked how watermain responsibility is determined. Benke <br />said this is a standard policy and asked staff to investigate the issue. <br /> <br />Gunderman suggested the Citizen Study Commission (CSC) review the <br />policy. Larson feels that staff should first review the policy. <br /> <br />Benke suggested that staff perform a preliminary assessment and based on <br />that, the CSC would be instructed to continue the review. Council <br />suggested that staff include in their review the creation of a notice which <br />would provide instructions when a home is left unattended. <br /> <br />Motion by Rebelein, seconded by Larson, to AUTHORIZE STAFF TO <br />REIMBURSE MR.
