Reconsideration, or total revocation, of the Special Use Permit may be considered due to safety or traffic patterns that are negatively impacted due to one or more of the following future events being triggered: County Road E2 Extension opens up west across the existing railroad tracks. a. The existing intersection controlled with stop signs at County Road E2 Extension and 5th Avenue NW is signalized. b. The City Planner explained a perpetual Special Use permit was requested for 2 one [y car sales per calendar year. otion by Council Member Burg seconded by Council Member Bauman to adopt the attached resolution that grants approval subject to the following conditions: 1. The applicant may hold one sale event in the spring and one sale event in the fall per calendar year, 2. The date of the vehicle sale events must be submitted and approved by City Staff at least 90 days in advance of the event and must be held on a Saturday or Sunday, 3. The sales may only be conducted between the hours of 8:00am and 4:30pm, 4. No more than 175 vehicles may be displayed for sale, 5. Vehicles for sale must be removed from the property no later than 6:30pm on the day of the sale, 6. The Director of Public Safety shall review and approve of each sale event and any traffic safety measure deemed necessary by the Director shall be implemented, and 7. If at any time the vehicle sale event creates a Public Safety concern and/or the conditions of this Special Use Permit cannot be met, the City Planner will require reconsideration of the Special Use Permit by notification to the applicant and by holding a public hearing with the Planning Commission. 14 Ayes - 0 Nays, Motion Carried 4.
