<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />April 28, 1992 <br /> <br />Page 7 <br /> <br />Council Business. continued <br /> <br />Motion by Rebelein, seconded by Larson, to AMEND THE LP-262 FIRST <br />CONDITION TO READ; "COUNCIL APPROVAL OF THE GRADING AND <br />DRAINAGE PLAN". <br /> <br />3 A yes - 2 Nayes (Benke and Gunderman) <br /> <br />Motion Failed. <br /> <br />Rebelein needs commitment that the attainment of the Army's forcemain <br />sewer pipe is feasible. <br /> <br />Proper said the site's topography constraints necessitates that part of the <br />church site drain to the east. Unless you move a mountain of earth, there <br />is not much more that can be done about the drainage to the east. The <br />vein grate option could be investigated by staff. <br /> <br />Rebelein feels this is an opportunity to correct the situation with a long <br />term solution. Gunderman said the intent of his motion reflects the concern <br />for an immediate solution to eliminating runoff to the backyards. <br /> <br />Williams asked Proper if he feels the plan illustrates the best solution in <br />managing runoff, and if other options would alleviate the problems. Proper <br />is unfamiliar with the area before the church was built. but suspects water <br />did flow down the hill into the backyards. He feels the plan improves the <br />situation by slowing discharge. Retention ponds are used as a way to <br />control runoff and he is not concerned that the pond would overflow. The <br />ponds would trade a flooding problem with a soggy backyard area. <br /> <br />Williams said it appears the City needs to develop options for the runoff <br />discharge. Based on Proper's clarification of the situation, Williams <br />reconsidered his vote and votes against the Rebelein motion. <br /> <br />Motion by Rebelein, seconded by Larson, to AMEND THE FIRST <br />CONDITION TO READ; COUNCIL APPROVAL OF THE GRADING AND <br />DRAINAGE PLAN. <br /> <br />2 Ayes - 3 Nayes (Benke, Gunderman and Williams) <br /> <br />Motion Denied. <br /> <br />Motion by Gunderman, seconded by Williams. to WAIVE THE READING <br />AND ADOPT THE RESOLUTION APPROVING SP-169; AND APPROVE LP- <br />262 SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. CITY ENGINEER APPROVAL OF GRADING AND DRAINAGE PLAN. <br />2. INCREASE WIDTH OF WESTERLY ACCESS DRIVE FROM 12 TO 14 <br />FEET PER THE CITY'S PARKING ORDINANCE REQUIREMENT. <br />3. PROVISION OF A PERFORMANCE BOND OR LETTER OF CREDIT <br />COVERING 100% OF THE COSTS TO INSTALL CURBINGS, <br />PARKING AREAS, AND LANDSCAPING. <br />4.
