<br />RESOLUTION NO. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING NC-71. <br /> <br />WHEREAS, an application for a nonconforming use permit has been <br />made by Chenoweth Greenhouses; and <br /> <br />WHEREAS, the procedural history of the application Is as follows: <br /> <br />J. That an application for a nonconforming use permit was flied with <br />the City on July II, 1986. <br /> <br />2. That the Planning Commission, pursuant to published and maIled <br />notices, held a public hearing on July 15, 1986, all persons present <br />at the hearIng were gIven an opportunity to be heard. <br /> <br />!' <br /> <br />3. That the applIcation for a nonconformIng use permit was <br />revIewed by the CIty CouncIl on July 22, 1986 and that the <br />comments and analysis of staff and the PlannIng CommIssion <br />mInutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City CouncIl that the <br />following Findings of Fact are made In respect to NC-71. <br /> <br />I. That the site Is zoned I-I, lIght Industrial. <br /> <br />2. That the site has the followIng type IV nonconformltles: <br />a. Less than required 15 foot side yard setback. <br />b. Less than required 40 foot front yard parking and <br />garden center setback. <br />c. Lack of concrete curbIng In a portion of front yard <br />parking area. <br />d. Less than required parking. <br />e. Lack of front yard landscaping. <br /> <br />3. That the applIcant has shown the total number and extent of the <br />nonconformities will be addressed as follows: <br />a. Provide additional parking. <br />b. Complete the curbing around all front yard parking areas. <br />c. Increase the side yard setback to 21 feet over 93 feet of the <br />existing nonconforming setback. <br />d. Reduce the size of the temporary garden center. <br />e. Eliminate parking In the front yard setback and Increase <br />front yard green space. <br /> <br />4. That the applicant has done everything practical to reduce the <br />existing Type IV nonconformitles at this time. <br /> <br />5. That because of the location of the existing front retail <br />buildings, the front yard landscaping cannot be substantially <br />Increased. <br /> <br />BE IT FURTHER RESOLVED that the application NC-71 !s and hereby <br />recommended for approval subject to approval of LP-201. <br /> <br />Adopted this 22nd day of July, 1986. <br /> <br />Robert J.
