<br />. <br /> <br />. <br /> <br />. <br /> <br />EMPLOYMENT AGREEMENT <br />CITY MANAGER <br />CITY OF NEW BRIGHTON, MINNESOTA <br /> <br />THIS AGREEMENT, made and entered into this 1 day of February, 2007, by and between the <br />City of New Brighton, a Minnesota Municipal Corporation, hereinafter referred to as "City" and <br />Dean Lotter, hereinafter referred to as "Lotter". <br /> <br />WITNESSETH: <br /> <br />WHEREAS, in an agreement dated October 19, 2006, the City and Lotter agreed to Lotter's <br />employment as City Manager effective February 1,2007; and <br /> <br />WHEREAS, both parties desire to establish the terms of said employment agreement as <br />hereinafter amended; <br /> <br />IT IS HEREBY AGREED AS FOLLOWS: <br /> <br />1. POSITION. <br /> <br />The City of New Brighton agrees to employ Lotter as its City Manager. Lotter agrees to serve as <br />the City Manager for New Brighton, will devote his full business time and best efforts to the City <br />of New Brighton and will engage in no outside businesses, except as authorized by the City <br />Council under Section 9 of this agreement. Lotter agrees to perform the duties of City Manager <br />as set out in the New Brighton City Ordinances as they are now in effect and hereafter may be <br />amended. Additionally, Lotter may be required to perform such other duties as may be required <br />by the City Council from time to time. <br /> <br />2. SALARY. <br /> <br />The City of New Brighton agrees to pay Lotter a salary of$105,000 per year, starting February <br />1,2007. The City agrees that Lotter's salary will be reviewed in January of each year, in <br />accordance with the review of the salaries of other City employees. The City Council agrees to <br />provide a formal performance evaluation of Lotter in November of each year. In addition to the <br />above salary, Lotter shall be eligible to receive a lump-sum payment of up to 5% subject to a <br />satisfactory performance evaluation, determined and paid in accordance with Chapter 17, Section <br />3 ofthe City Administrative Code. <br /> <br />3. PENSION COMPENSATION. <br /> <br />PERA. The City shall execute the necessary documents to allow Lotter to enroll in Public <br />Employees Retirement Association (PERA) and make the requisite employers contribution to <br />PERA. <br /> <br />G:\PERSONNE\Contract\2007 Lotter Employment Contract.doc <br />
