EXTRACT OF MINUTES
REGULAR MEETING
PLANNING COMMISSION
FEBRUARY 17, 1987

PUBLIC HEARINGS

4. 8:35 - 9:07 p.m.

NC-78/SP-139/LP-207

MacGillis & Gibbs

Mattila briefly reviewed the case report to consider an
application for a non-conforming use permit, special use permit,
and site plan review for a truck weigh scale to be placed on the
MacGillis & Gibbs site.

Mattila stated he spoke with the PCA; they are concerned with any
excavation on the site; the PCA would like to see any soils
excavated on the site remain on the site so the soils may be
monitored for pentachlorplenal and other pollutants.

Baker questioned who would actually be testing the soils, the
applicant or the PCA.

Mattila responded the PCA or the Minnesota Health Department;
added, according to Mark Lahtinen, the remedial investigation
study for pollutants on the site will be completed at the end of
March of 1987.

Blomquist questioned how the City would ensure the correcting of
the existing non-conformities.

Mattila responded through the enforcement powers granted by the
Zoning Ordinance; stated if the applicant has not complied within
a reasonable amount of time, letters would be sent to MacGillis &
Gibbs, and as a last resort, the City would cite the property
owners.

Blomquist asked if approval for this proposal could be
conditioned on these items being corrected before construction of
the weigh scale could be started.

Mattila answered affirmatively; the enforcement program could
actually begin anytime because the items are presently in
violation.

Frank Schuette, Controller, MacGillis and Gibbs, stated they
would like to begin construction as soon as possible.

Becker suggested continuing the hearing for 30 days contingent
upon receiving a time schedule from the applicant as to the
completion of the existing non-conformities.
