<br /> <br />EXTRACT OF MINUTES <br />REGULAR MEETING <br />PLANNING COMMISSION <br />FEBRUARY 17, 1987 <br /> <br />PUBLIC HEARINGS <br /> <br />4. 8:35 - 9:07 p.m. <br /> <br />NC-78/SP-139/LP-207 <br /> <br />MacGillis & Gibbs <br /> <br />Mattila briefly reviewed the case report to consider an <br />application for a non-conforming use permit, special use permit, <br />and site plan review for a truck weigh scale to be placed on the <br />MacGillis & Gibbs site. <br /> <br />Mattila stated he spoke with the PCA; they are concerned with any <br />excavation on the site; the PCA would like to see any soils <br />excavated on the site remain on the site so the soils may be <br />monitored for pentachlorplenal and other pollutants. <br /> <br />Baker questioned who would actually be testing the soils, the <br />applicant or the PCA. <br /> <br />Mattila responded the PCA or the Minnesota Health Department; <br />added, according to Mark Lahtinen, the remedial investigation <br />study for pollutants on the site will be completed at the end of <br />March of 1987. <br /> <br />Blomquist questioned how the City would ensure the correcting of <br />the existing non-conformities. <br /> <br />Mattila responded through the enforcement powers granted by the <br />Zoning Ordinance; stated if the applicant has not complied within <br />a reasonable amount of time, letters would be sent to MacGillis & <br />Gibbs, and as a last resort, the City would cite the property <br />owners. <br /> <br />Blomquist asked if approval for this proposal could be <br />conditioned on these items being corrected before construction of <br />the weigh scale could be started. <br /> <br />Mattila answered affirmatively; the enforcement program could <br />actually begin anytime because the items are presently in <br />violation. <br /> <br />Frank Schuette, Controller, MacGillis and Gibbs, stated they <br />would like to begin construction as soon as possible. <br /> <br />Becker suggested continuing the hearing for 30 days contingent <br />upon receiving a time schedule from the applicant as to the <br />completion of the existing non-conformities. <br />
