<br />CHAPTER IV - 9 <br /> <br />2. Fences shall be located entirely upon the private property <br />for the person, firm or corporation constructing, or <br />causing to be constructed such fence. <br /> <br />Fences shall not be erected in the boulevard area of public <br />streets. <br />3. Every fence shall be constructed in a substantial skillful <br />manner and of substantial material reasonably suitable for <br />the purpose for which the fence is proposed to be used. <br />Every fence shall be maintained in a condition of <br />reasonable repair and shall not be allowed to become and <br />remain in a condition of disrepair or danger, or constitute <br />a nuisance, public or private. Any such fence which is, <br />or has become dangerous to the public safety, health or <br />welfare, is a public nuisance, in accordance with Chapter <br />17 of the City Code. <br />4. Fences constructed, or partially constructed, of barbed <br />wire shall only be permitted in industrially zoned district <br />and shall conform with the requirements of section 6-400. <br />5. On any corner lot no fence shall be erected in the triangle <br />formed by the front lot line, side street lot line and a <br />straight line joining points on such property lines thirty <br />(30) feet from their intersection at the corner, of the <br />lot when such action would materially impede vision <br />between a height of two and one-half (2~) and ten (10) <br />feet above the centerline grades of the adjacent inter- <br />secting streets. <br />6. Fences for special purposes and fences differing in con- <br />struction, height, length or location from the requirements <br />of this section may be permitted in any district in the <br />City of New Brighton by the issuance of a special use <br />permit approved by the city council that (1) such special <br />purpose fences are necessary to protect and buffer the <br />premises for which such fences are intended or adjacent <br />fences are intended or adjacent premises, and (2) would <br />not be deleterious to adjacent property, nor to the general <br />public health, safety, or welfare, and (3) would not be <br />inconsistent with the intent and purpose of <br />these fence regulations as stated in section 4-540 a. <br />Such special fence permit,if issued, may stipulate and <br />provide for the height, location and construction type <br />of special fence thereby permitted or any other condition <br />deemed necessary to protect the public health, safety and <br />general welfare. <br />d. Residential districts. In any part of New Brighton zoned <br />residential, no fence shall be erected except in conformance <br />with the following requirements: <br />1. Fences erected in the front yard of a lot, as defined <br />in sections 2-720 and 2-B20, shall not exceed three and <br />one-half (3~) feet in height and shall have at least <br />seventy five (75) percent of their vertical surface <br />plane open when viewed from a point perpendicular to <br />that plane. <br />2. Fences in yards other than a front yard shall not exceed <br />six (6) feet in height and shall be constructed so as <br />to permit a free flQw of air. <br />
