An application for a variance was filed with the City of New <br />Brighton on February 3, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on February 21, 1989, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br /> <br />NOW THEREFORE BE' IT RESOLVED, the Planning Commission makes <br />following Findings of Fact in respect to VN-273: <br /> <br />1. The subject site is zoned 1-1, Light Industrial. <br />2. The subject site contains pockets of poor soils and is a long and <br />narrow corner lot with a great deal of street frontage and <br />separated from an R-1A district by 5th Street NW, resulting in <br />increased setbacks and limited developable area. <br />3. Section 11-020 (f) of the City's Parking Ordinance requires all <br />off-street parking areas in the industrial district to provide a 5 <br />foot setback from the rear property line. <br />4. The proposed off-street parking area would be setback 3 feet <br />from the rear property line. <br />5. Strict enforcement of Section 11-020 (f) would cause an undue <br />hardship because of circumstances unique to the individual <br />property under construction. <br /> <br />.1 <br />:i BE IT FURTHER RESOLVED, the application for VN-273 is hereby <br />ijrecommended for approval subject to the following conditions: <br />H <br />!i 1.
