<br /> <br />RESOLUTION NO. <br /> <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A VARIANCE, <br />VN-289. <br /> <br />WHEREAS, an application for a variance has been made by Ryan Construction; <br /> <br />and <br /> <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on <br />November 20, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on December 1 and December 8, 1992, and all persons <br />present at the hearing were given an opportunity to be heard. <br />3. The City Council considered VN-289 at its meeting on December 8, 1992. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following <br />Findings of Fact in respect to VN-289: <br /> <br />1. The subject property is zoned 1-1, Light Industrial. <br />2. The maximum building height in the district is 40 feet. <br />3. The proposed unit load portion of the proposed warehouse building would be <br />75 feet in height. <br />4. In order to construct the proposed warehouse building, a height variance of <br />35 feet from Section 6-060 (F) would need to be approved. <br />5. The proposed unit load facility would represent 7.6 % of the total roof area <br />of the proposed warehouse. <br />6. The proposed unit load facility would be unique in that it would be occupied <br />exclusively by an Automated Storage and Retrieval System (ASRS) and <br />would not be used for office space and would only occasionally be occupied <br />by employees. <br />7. The south face of the unit load facility would be landscaped with a 6 foot <br />berm and coniferous and deciduous trees. <br />8. The intent of the 40 foot height limitation in the 1-1, Light Industrial district <br />is to minimize the impact of the proposed use on surrounding land uses. <br />9. The unit load facility would be separated from industrial land uses to the <br />north by Jones Lake and a 150 foot setback from the Jones Lake normal <br />high water mark. 1-35W to the east would be separated by a stand of <br />mature trees, high power line towers, a county drainage ditch, and the <br />exterior storage area screening. The two and a half story apartments to the <br />west would be separated by a two story wellhouse and a 165 foot high City <br />water tower.
