<br />.......lo <br /> <br />Page 6 <br /> <br />The Planning Commission recommended the rezoning request be approved so the proposed development <br />may be built and the single family home on the lot adjacent to the north may continue as a permitted use. <br /> <br />The City Council has three options available to choose from regarding the rezoning request: <br /> <br />1. Approve the rezoning of the entire R-2, Two Family Residential district area to B-1, <br />Limited Business. <br /> <br />This option would allow the applicant to develop the proposed office building, but would <br />also cause the single family home adjacent to the north to become a type IT nonconforming <br />use. As a type IT nonconforming use, the single family home could not be expanded <br />without converting the home to a B-1 permitted use (unless the City Council granted <br />permission to expand). The lot would be marketable as commercial property and would <br />most likely be developed with an office building in the future. The applicants's proposed <br />office building would be setback 25 feet from the north property line. A portion of the 25 <br />feet setback area could be added on to the northerly lot, if needed for additional <br />commercial site area in the future. <br /> <br />The owner of the lot adjacent to the north would be in favor of this option if he were <br />bought out and relocated from the site. <br /> <br />The applicant has met with the owner of the above lot to encourage him to include his lot <br />in the rezoning, but the owner of the lot to the north was unwilling to participate in the <br />rezoning unless he were relocated. <br /> <br />2. Approve the applicant's request to rezone a large portion of the R-2 district area to <br />B-1. <br /> <br />This option would allow the applicant to develop the proposed office building and would <br />allow the single family home located on the lot adjacent to the north to continue as a <br />permitted use. The single family home could be expanded under this option. <br /> <br />The owner of the lot to the north would not be in favor of this option because he and his <br />family do not want to live between an office building and an apartment complex. He is <br />also concerned over the value and marketability of his residential lot if this option were <br />approved. <br /> <br />3. Deny the applicant's request to rezone a large portion of the R-2 district to B-l. <br /> <br />This option would not alter the existing R-2 district. Currently, the existing R-2 district <br />could accommodate up to three single-family homes, or three two-family homes, or six <br />townhouse units. <br /> <br />The single family home on the lot to the north could conti.nue as a permitted use. <br />Obviously, the owner of said lot would be in favor of this option. <br /> <br />The lot to the north is not proposed to be included in the applicant's site plan because the <br />additional land area is not needed to build the proposed office building. <br />
