To allow for <br />access over the publ ic road purposes, the language "subject to <br />Cl eve 1 and Avenue SE over the easterl y 33 thereof" has been added to <br />the proposed legal descriptions. Cleveland Avenue has been <br />dedicated through the platting process which establishes boundaries <br />for lots and public right-of-way areas. <br /> <br />The varying description methods caused the Cleveland Avenue right- <br />of-way to appear as if it jogs from Parcel A and Parcel B. In <br />actuality, the City's right of acceSs over Parcel A and B does not <br />jog, but extends over the east 33 feet of both Parcel A and Parcel <br />B. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING PL-182; AND WAIVE THE READING AND <br />HOLD A SECOND READING AND ORDER PUBLICATION OF AN ORDINANCE AMENDING <br />THE NEW BRIGHTON ZONING ORDINANCE REZONING CERTAIN PROPERTY IN NEW <br />BRIGHTON FROM R-2, TWO FAMILY RESIDENTIAL, TO B-1, LIMITED BUSINESS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Council Business <br /> <br />Minor Subdivision/ <br />Rezoning for U.S. West <br />- Don Leier <br />Report 89-248 <br />Resolution 89-135 <br />Ordinance 571 <br /> <br />Childs presented a petition from 46 New Brighton residents <br />requesting the installation of a City sidewalk on County Road E County Road E <br />between Silver Lake Road and Stinson Boulevard. Sidewalk Petition <br />Report 89-249 <br />The normal procedure is for Council to officially receive the <br />petition and refer it to staff for a feasibility study. <br /> <br />Staff recommends the feasi bi 1 ity study be prepared inhouse thi s <br />winter, which would enable sidewalk installation in the early summer <br />of 1990, if approved by Council. <br /> <br />Williams supports the requested action and noted this area had been <br />discussed in the past in connection with the Greenway/Sidewalk Plan. <br /> <br />Motion by Williams, seconded by Gunderman, to RECEIVE THE PETITION <br />FOR A SIDEWALK ALONG COUNTY ROAD E BETWEEN SILVER LAKE ROAD AND <br />STINSON BOULEVARD AND REFER IT TO STAFF FOR STUDY AND REPORT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br />
