<br />I <br /> <br />I <br /> <br />I <br /> <br />CQuncil Meeting Minutes <br />April 25, 1989 <br /> <br />Page 20 <br /> <br />Council Business, continued <br /> <br />A resident from Windsor Green said a meeting was held at the complex <br />and a large number of residents attended. 89.5% of the residents <br />voted to approve the projects, subject to Council approval. <br /> <br />Motion by Brandt, seconded by Larson, to WAIVE THE READING AND ADOPT <br />THE RESOLUTIONS APPROVING PRD-52 AND PL-179; AND APPROVE THE LP-242 <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. INCREASE THE WIDTH OF THE PROPOSED DRIVEWAY TO 24 FEET. <br />2. PROVISION OF STRIPING FOR 3 STALLS ON SITE; LOCATION TO BE <br />APPROVED BY CITY PLANNER. <br />3. A PERFORMANCE BOND OR LETTER OF CREDIT BE POSTED WITH THE CITY <br />IN THE AMOUNT EQUAL TO 100% OF THE COST OF ALL SITE <br />IMPROVEMENTS, EXCLUDING THE BUILDING, PRIOR TO ISSUANCE OF THE <br />BUILDING PERMIT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Mattila presented for consideration a request for site plan review, <br />minor subdivision and setback variance for Interstate Centre <br />Development. <br /> <br />The proposed office/warehouse development would be constructed in <br />t;,o phases. Each phase woul d consi st of a 40,500 square foot <br />s7ructure. Together the structures would offer 64,000 square foot <br />of office space and 16,000 square feet of warehouse service area. <br />The office space would be designed to face outward while the <br />warehouse area would face inward. <br /> <br />In order to accommodate additional road surface on County Road D, <br />the County acquired seven additional feet of right-of-way along a <br />portion of the subject site's south property line. The requested <br />seven foot setback variance for the front yard off-street parking <br />area would only affect the western two-thirds of the front yard <br />setback area. The line delineating the additional right-of-way area <br />tapers from 40 feet to 33 feet for a distance of 135 feet, then runs <br />parallel to the subject site for another 190 feet. <br /> <br />The applicant pursued the possibility of moving the proposed <br />building back seven feet, but was unsuccessful due to the location <br />of the existing sanitary sewer pipe. Therefore, it appears an <br />unique circumstance and undue hardship has been created by the <br />acquisition of the additional right-of-way along County Road D and <br />the location of the existing sanitary sewer pipe.
