The ass i gnment of sick 1 eave from one employee to <br />another is upon the discretion of the Council. <br /> <br />Thomson has reviewed all the union contracts. The personnel code <br />provides that employees who are covered by the bargaining contract <br />are exempt from any code provi si ons that confl i cts wi th thei r <br />collective bargaining agreement. Thomson does not see a provision <br />in the bargaining agreements that would conflict with the adoption <br />of this amendment. <br /> <br />Ti'omson recommended to the Ci ty Manager, in order to prevent <br />disagreements with the collective bargaining units, some form of <br />understanding should be communicated. <br /> <br />Banke asked what procedures should be followed to prevent this issue <br />from becoming a stumbling block in labor negotiations. <br /> <br />Orduno has spoken to Stan Kowalski, union representative for the <br />Powerhouse employees. Mr. Kowalski feels this amendment would be <br />considered a benefit instead of leverage in future bargaining. Mr. <br />Kowalski said the union may consider providing a memorandum of <br />understanding. A memorandum of understanding insures that the issue <br />would not be used in future negotiations. <br /> <br />Williams verified that if an ordinance was adopted, an employee <br />would continue to receive medical benefits. Orduno said the <br />employee would not be able to accrue additional sick leave or <br />vacation time, but would receive pay and medical insurance. <br /> <br />Williams asked if the cost to the City would be similar if either <br />sick leave or vacation time was assigned. Benke explained that the <br />reassignment time is considered a speculative cost and would be <br />borne by the City, as opposed to a real upfront cost of vacation <br />time. <br /> <br />Benke would support the option of a combination pol icy of sick <br />l~ave/vacation time, and feels this option would reflect the Team <br />Building philosophy.
