<br />1 <br /> <br />III <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 28, 1989 <br /> <br />Page 9 <br /> <br />Council Business, continued <br /> <br />Motion by Benke, seconded by Gunderman to WAIVE THE READING AND <br />APPROVE THE RESOLUTION DESIGNATING INSTITUTIONS AS DEPOSITORIES OF <br />CITY FUNDS AMENDED TO DELETE ALL REFERENCES TO FIRST STATE BANK OF <br />NEW BRIGHTON. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Erny Matti 1 a, City Pl anner, presented the request to approve a <br />setback variance to construct a gas station/convenience store on a <br />B-3 Parcel. <br /> <br />The applicant is proposing to demolish the existing Fina station and <br />construct a new 1,936 square foot gas station/convenience store. <br /> <br />A 15 foot front yard setback is proposed by the app 1 i can t. Th i s <br />would require a setback variance of 15 feet to be approved by the <br />Council. A 30 foot front yard setback is proposed by the applicant. <br /> <br />Mattila met with the Birch Pond Condomium Association and they have <br />voi ced two concerns, dra; nage and screen; ng. Worki ng w; th the <br />appl icant a landscaping/screening plan has been considered <br />satisfactory by the Association. <br /> <br />Ramsey County has requested 17 feet of additional right-of-way along <br />Silver Lake Road and 16.5 feet of right-of-way along County Road E. <br />With the County's request, staff has seen this application as an <br />undo hardship in an unique circumstance and recommends approval of <br />the variance and site plan. <br /> <br />The Planning Commission held a Public Hearing on February 21, 1989 <br />and recommended approval of LP-240 and VN-272. <br /> <br />Brandt asked Mattila to locate on the blueprint the location of the <br />existing building. Mattila explained that the new building will be <br />located further to the East. One curbcut would be eliminated and <br />two additional gas pumps would be installed. The new building <br />would be 250 square feet larger than the existing building. <br /> <br />Brandt asked if the owners would continue to operate the existing <br />building while the new building is being constructed.
