This 1/3 <br />is over and above any other caps that have been placed on the <br />community by the State of Minnesota. However. the provision to <br />change the mi 11 1 evy in the State Statute is under revi ew by the <br />Legislature this year. <br /> <br />The MSABC is responsible for the management of the armory. paying <br />the bills. and the management of any funds until the bonds are paid. <br />The MSABC wi 11 try to rent the armory when not in use by the <br />Nati ona 1 Guard or the City. Any funds recei ved, wi 11 go towards <br />operati ona 1 costs. The communi ty does get the fi rst ri ght of <br />refusal after the National Guard. <br /> <br />Construction will comply with all State and City ordinances, State <br />Statutes and building codes. <br /> <br />Benke asked if the authorization for the mill levy would be the <br />City's portion of the bond cost. The bonds would be levied but the <br />City would have prior agreement to contribute its share to the bond <br />payment. <br /> <br />Nesbett said the MSABC would ask the City for a irrevocable <br />resolution which says the City would participate. Once the bonds <br />are sold, the MSABC would compute what the City share would be. An <br />amendment to the resolution is then required indicating the dollar <br />value. This dollar value would be billed to the City on an annual <br />basis. <br /> <br />Benke asked if the authority for taxes to be levied requires a <br />referendum. <br /> <br />Nesbett said as long as the City stays below 1/3 of a mill a <br />referendum is not required. <br /> <br />LeFevere commented that it is not uncommon to have very limited mill <br />levy authorization without a referendum. <br /> <br />Benke feels the referendum issue should be verified since the City <br />is responsible for the commitment of these funds.
