The Planning Commission has recommended denial of this <br />request; based on the fact that the lot is large enough to <br />accommodate he detached garage and still meet the five foot <br />setback. <br /> <br />Mr. August P ron, 999--3rd Avenue NW, expressed his dissatisfaction <br />with the Pla ning Commission recommendation. Mr. Paron explained <br />he would wan to construct this garage to sit square on his lot, not <br />angled, whic is what the Staff and the Planning Commission have <br />suggested. <br /> <br />Les Proper, City Engineer, explained, the City setback requires <br />compliance with the five foot rear-yard setback from the alley for <br />snow plowing purposes. <br /> <br />Benke explai ed to Mr. Paron, that it is technically required by law <br />to construct the garage fi ve feet from the alley; but in un i que <br />circumstance, such as, preventing a resident from making productive <br />use of the p operty; the City would approve a variance to put the <br />property in ompliance. <br /> <br />Benke asked Proper, if the garage coul d be moved a <br />little West 0 avoid the setback problem. Mattila explained, that <br />there is ade uate space on the lot to meet the five foot setback; <br />and if the C uncil were to approve this variance, it would set a <br />precedence f r granti ng vari ances simil ar to thi s throughout the <br />City. <br /> <br />Mattila <br />Larson. <br /> <br /> <br />slides pertaining to this property, as requested by <br /> <br />Williams ask d Mattila the location of the alley right-of-way. <br />Mattila said he was not sure where the right-of-way is, but said <br />this easemen is 14 feet wide; compared to a typical alley which is <br />10-12 feet w"de. <br /> <br />Williams and Benke suggested to the Staff they locate and stake the <br />right-of-way for Mr. Paron sometime this week.
