<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 25, 988 <br /> <br />Council Busi ess continued <br /> <br />Motion by Ben e, seconded by Williams, TO CONTINUE THE CONSIDERATION <br />OF A RESOLUT ON FOR A VARIANCE TO CONSTRUCT A DETACHED GARAGE 2' <br />FROM SIDE AN REAR PROPERTY LINES (VN-269, AUGUST PARON) TO THE <br />NOVEMBER 7TH CITY COUNCIL MEETING; AND REQUEST STAFF TO ASSIST IN <br />LOCATION OF HE RIGHT-OF-WAY LINES AND THE SETBACK VARIANCE AND <br />REPORT BACK 0 THE COUNCIL. <br /> <br />5 Ayes - 0 N yes, Motion carried. <br /> <br />Mattila presented an application for a setback variance to allow the <br />construction of a parking lot within the required setback area <br />located at 7 0 West County Road D. <br /> <br />The applican is requesting a variance to expand their existing <br />parking lot t within five feet of the Highway 88 right-of-way line; <br />and up to he Long lake Road right-of-way line. This would <br />accommodate n additional 42 stalls on the site. <br /> <br />Staff has re iewed the proposal and would recommend an identical <br />variance alo g Highway 88 up to five feet of the Highway 88 right- <br />of-way with he provision of a coniferous planting along the five <br />foot area. T e elimination of six of the proposed stalls along Long <br />lake Road wou d allow for a nine foot setback from the right-of-way. <br />This nine fo t setback would still provide for 116 stalls (7 more <br />than would b required by the City's Proposed Parking Ordinance). <br /> <br />The Planning Commission had a public hearing on October 18, 1988; <br />and came to 2-2 vote on this item; and, therefore, the Commission <br />proposed no ecommendation. <br /> <br />The Commissi ners who voted against the applicant, felt that this <br />current vari nce can not be approved because the hardship was <br />created by the applicant, in regards to the previous variance. The <br />previous var ance involved the solarium on the East side of the <br />building and the storage area on the West side of the building. <br /> <br />The Commi ss i ners who voted in favor of the app 1 i cant, fe It the <br />existing problem needs to be addressed; and the hardship was <br />determined tbe in existence prior to the previous variances.
