He also noted the Fire Departments <br />concern regarding the width of the driveway lane at the rear of the. <br />property and their desire that fire hydrants be shown on the plans. It <br />was also noted that contour lines for the site should be referenced to <br />U.S. Government Survey data. <br />Gary Hiner appeared representing the petitioner. <br />In response to a question by Daniels as to whether he was aware of the <br />requirements for granting a variance, Mr. Hiner explained that he was and <br />that he felt the conditions existed in this case. He stated that <br />required setbacks and easements take 38% of the property and that to be <br />developed economically variances are necessary. He stated that the <br />100' setback requirement would create a hardship in developing the <br />property. He further stated that the proposed development was in <br />character with what is currently in the area and would not be detrimental. <br />Daniels stated that the 100' setback would also be a hardship for <br />others attempting to develop industrial land across the street from a <br />residential area. <br />In response to a question by Formell, the Administrative Assistant <br />stated that if the property were rezoned to B-3 no variance for front- <br />yard parking and front-yard building setbacks would be necessary. <br />Formell stated his feeling that the proposal is in character with the <br />surrounding area. <br />Daniels agreed with the comment by Formell and stated that he would be <br />willing to recommend that the Council initiate a rezoning to B-3 for <br />the whole area, including Sambo's. He stated that he is not in favor <br />of granting the variances requested. <br />Parham stated that it did not seem that the conditions for a variance <br />exist.
