SP-52 <br />p. 3 <br />at 9:50 p.m. Mann left. <br />Formell and Daniels agreed with Parham that the conditions for a <br />variance were not met. <br />Bohling stated that he favored a change in zoning. <br />PLANNING COIM4ISSION RECOMMENDATIONS: <br />Motion by Bohling, seconded by Parham, to recommend denial of VN-109 <br />on the basis that the conditions necessary for the granting of a <br />variance, as specified in Section 2-700 of the Zoning Code, are not met <br />in this case <br />Motion carried 4-0 <br />Motion by Bohling, seconded by Formell, to recommend that the Council <br />initiate a rezoning to B-3 of the property discussed in VN -109 and <br />SP-52 and other property south of it, north of County Road D, west <br />of New Hgihway 8 and east of Old Highway 8. <br />Daniels stated his concern regarding the effect of such action on the <br />property which is alreddy developed and whether it would decrease the <br />value of this property. <br />Motion by Daniels, seconded by Bohling to amend the motion to state <br />the recommendations that the property discussed in VN-109 SP-52, <br />be rezoned to B-3 and that consideration be given to rezoning adjacent <br />property in light of the possible legal ramifications of such a move. <br />Motion Carried 4-0 <br />Motion by Daniels, seconded by Parham, to advise the Council that the <br />intent of the Planning Commission is that the property discussed under <br />VN-109, SP-52 and adjacent property be rezoned to B-3 and that <br />conditioned on this rezoning that the Special Use Permit requested in <br />SP-52 be approved. <br />Motion carried 4-0
