<br />SP-68 -2- <br /> <br />1. The excavation and fill proceed according to the delineated <br />stages and conform in all respects to the grading plan <br />presented, signed and dated (date of approval) . <br /> <br />2. That each individual stage be started and completed by the <br />end of each working season. (A completed stage shall mean <br />that the distu:tibedarea be filled to the elevations <br />indicated on the plan, covered with topsoil and seeded. <br /> <br />3. That all non-earth materials be covered and not exposed <br />over weekends and holidays. <br /> <br />1. That disturbed areas be covered with at least 411 of topsoil <br />and seeded with a mixture of Kentucky Bluegrass (15 lbe/acre), <br />Creeping Red Fescue (10 Ibs/acre), and Per~nnial Ryegrass ' <br />(3 Ibs/acre) or equivalent approved by the Building <br />Inspector. <br /> <br /> <br />5. That all fill materials be subject to all provisions of <br />the New Brighton Code of Ordinances. <br /> <br />6.' That suitable precautions, meeting the Building Inspector's <br />approval, be taken to insure that damage is not done to <br />existing structures. <br /> <br />7. That there be no filling of or disturbance to the water <br />area located at the 889' level in the southeast corner <br />of the site. <br /> <br />8. That a $20,000 performance bond be posted. <br /> <br />9. That no stockpiles be greater than 15' in height. <br /> <br />Notification and plans of the applicant's request were provided <br />to the Minnesota State Highway Department. The Highway Department <br />has indicated that their primary concern is soil erosion, and that <br />necessary erosion control procedures be employed during and after <br />excavation. The Highway Department has also indicated that a <br />permit from them would not be required since the project will <br />not infringe upon the 35W right-Of-way. <br /> <br />It is noted that a letter has been received from the applicant <br />indicating that he would be unable to attend the March 23 public <br />hearing and requesting that the public hearing be continued to <br />April 13. <br /> <br />Planninq Commission Consideration & Recommendation (Feb. 17, 1976.): <br />Please See Attached <br />
