The portion of
2nd street that is requested to be vacated is comprised of the old
Cleveland Avenue right of way and a portion of the current 2nd St.
right-of-way. Mayor Benke asked if the remaining right-of-way ad-
equately provides for the streets that are envision in that area.
Erny confirmed this as true, and added that these portions would
not have a public purpose.

Being no comments from the audience, motion by Benke, seconded by
Brandt, to CLOSE PUBLIC HEARING.

I

Charles LeFevere, City Attorney, mentioned that there is one prop-
erty in this area that has not been closed on. LeFevere felt if
anything went wrong with the purchase, it may be necessary to con-
demn, which the City would not want to do. LeFevere suggested
that the approval of the resolution should be effective upon the
signature of the Mayor, and the Mayor be authorized to sign the
resolution upon the closing of this property. Mayor Benke acknow-
ledged that this would be appropriate action. Mayor Benke motio-
ned to CLOSE PUBLIC HEARING.

5 Ayes - 0 Nayes, Motion Carried

Motion by Benke, seconded by Williams to WAIVE THE READING AND A-
DOPT A RESOLUTION TO VACATE A PORTION OF THE 2ND ST.
