<br />(~ <br />e <br /> <br />( <br />e <br /> <br />e <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />~ <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-10l <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-10l has been made by Salem Baptist Church to use a single <br />family dwelling as a classroom; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an :application for special use permit, SP-10l was file <br />with the City of New Brighton on November 3, 1981. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on NDvember 17, 1981, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />3. That such application was reviewed by the City CDuncil on <br />November 24, 1981, <br />4. The written comments and analysis of the city staff, the <br />Planning Commission minutes and recomme~dations were <br />cOnsidered. .' - <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in ~espect to SP-IOl. <br /> <br />That the propertY is zoned R-l, Single Family Residential; <br />That the church will use the property for one hour on- <br />Sunday, l~ hours on Wednesday evenings and possibly for <br />other future functions; <br />That the Church can not give a schedule .of actual hours <br />or events that the house will be used; <br />That the establishment of the use has been with no regard - <br />to City/State codes which regulate/provide for the public <br />health, safety and welfare; <br />That the numerous code violations will require numerous <br />structural modifications which will alter the "residential" <br />character of the structure; <br />That beLDuse of its location in the community that such <br />exterior/interior modification will have an adverse affect <br />on adjoining properties; and . <br />That such a use provides additional encroachment of a quasi <br />public-~se with-increased-traffic-and noise into an <br />established residential area; and <br />That the "life safety" improv~~ents will alter the house in <br />such B_manner as to diminish its future re-use as a single <br />family dwelling. <br /> <br />BE IT FURTHER RESOLVED, that the application SP-101 is hereby <br />denied. <br /> <br />1 . <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br /># <br /> <br />AdopteP this <br /> <br />, 1981. <br /> <br />day of <br /> <br />James W.
