j ,. <br />PROPOSED RESOLUTION <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />A RESOLUTION DENYING THE REQUESTED VARIANCE VN-114 AND STATING THE <br />REASONS THEREFORE <br />WHEREAS Road Machinery Equipment and Supply Company has requested <br />a variance from Section 10-110(h) of the New Brighton Zoning Code to <br />allow an existing front yard parking area to continue-in an industrial <br />district, and <br />WHEREAS a representative of Road Machinery Equipment and Supply <br />Company has stated that the front yard parking area was constructed by <br />them without permission from the City of New Brighton and as a departure <br />from the approved plot-and landscape plan for the property in question,and <br />WHEREAS such error was detected by the Building Inspector at the <br />time of building construction and plot plan completion-and the <br />applicant notified at that time of the violation, and <br />WHEREAS the Advisory Planning Commission has reviewed the requested <br />variance and recommended against it being granted because the conditions <br />for the granting of a variance as specified in Section 2-700 of the <br />New Brighton Zoning Code are not present <br />NOW THEREFORE BE IT RESOLVED by the City Council of the City of <br />New Brighton that the requested variance, VN-114, does not involve a <br />condition of undue hardship, unique circumstances, or a condition <br />applying to property and is hereby denied. <br />Adopted this day of 1974. <br />ATTEST: Gayle C.
