Oakwood Drive.-
-Requeste. Variance from Section 13-050 (f) and 13x_060 ~to
allow construction. of a 10' high fence in a :front
yard.
Discussions ~
The applicant wishes to enclose a concrete. pad. on his property with
~_:a 10' fence in order"to use the .area as a tennis court-and 'chi.~.dzen's
-play. area. , ,
'The pad appears to be set back a distance of 15 £~et £ram ~:3:is c:t~rb
on Oakwood Drive and 24 feet from the curb on 3rd street SW. ~.'ne
~elewaton of the 'pad is about 5 feet above the center line of
3rd'Street SW. The pad is located in what is actually the fri~nt
yard of the lot.
Because of the relative differences in elevation between the pad
and the roadwey, any fence, no matter what its hoight; w~:uld
interfere vrth the line of sight of ~fr.~.vers approaching the inter-
section. T1ze Zoning Code does not permits this (Section 13-C60).
The e~iisten.we of a stop sign on 3rd Street Slid so~~~:N~~.t. .r ~t:t~.ve~ •Lk~e
concern regarding the effect on line of sight ~rY:ich the ferice would
have. It should be noted th~.t cr~ntours of tre yard already block
a driver's line of sight.- Our records do not show that a permit'
~,ras ever oaken cut :for thin grading and for the laying of the
slab, although this may have been included in the .permit for. the
house. ~~t any rate, existing grades on the preliminary plat showed
this area about 2~' above the street elevation which would not-have
created -a. problem.
This fence is going to severely screen the lot to tze east„ Thy
gad r~zns from one side lot.-line to the. other and on Iha cast ~.^
abc:~t 2?' `- 3 ` above the grade of the abutting let. ~~n~ rest ~_•~. of
p~.xtting in the fence would be a barrier with r..o setbar..k 12 2' ~~ 13'
ab~:?ve the grads of the abutting lot. This fence z=_L11 axtend wthin-
~~ 24' o_~ the road whereas the-house on the next lot will be no closer
t~lan 46' to the road. The house will be completely hidden from the
vrest and t,~il:l .have no view at' all in that dirk ai x:21.
l _ -
