<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 22, 1987 <br /> <br />In response to Benke's inquiry regarding Robinson's consideration <br />of improvements in the foreseeable future, Robinson stated he has <br />made some. Robinson also stated he lives there (grandfathered in) <br />and is required to add five feet to the garage to square off the <br />building which they cannot do and questioned whether a garage is a <br />non-conforming entity; the petition asks that all excess right-of- <br />way be vacated so the over-head garage doors would be 75 feet off <br />the street. <br /> <br />Because Robinson has a great need for space, he would like to dig <br />a basement and join two buildings for a cold-type storage struc- <br />ture which would be an improvement to the property. <br />Robinson stated he is willing to do landscaping as he does not <br />want to move because it is an ideal location for his business. <br /> <br />As the city has to find it in its and the public's best interest <br />to release a right-of-way, Benke asked if the vacation could be <br />conditioned on the elimination of the non-conformities. <br /> <br />LeFevere stated there is a line of distinction regarding public <br />interest being served: either it has to be related to the purpose <br />of the roadway in the first place, or the council would need the <br />road to fulfill a public purpose (the corridor concept) which the <br />site plan would have to take into consideration. <br /> <br />Benke questioned staff about Robinson1s landscaping plans compared <br />to what the city might develop in the corridor landscape plan. <br /> <br />Williams stated the problem is we do not have a master landscape <br />plan to be taken into account; and noted the plant materials plan- <br />ned are nice but we do not know if they will fit the scheme and <br />suggested shade trees that would mature, along with smaller trees, <br />might be more indicative of corridor planning. <br /> <br />Benke asked city attorney if council could approve a vacation sub- <br />ject to the Planning Commission's approval of site plan and land- <br />scape plan; LeFevere stated it could, but the first risk associa- <br />ted with it is, because it involves a vacation, if an appropriate <br />landscape plan is approved, it would be difficult for the city to <br />maintain its easement. <br /> <br />Benke felt bothered with just having a concept plan for a whole <br />area, but believes it is unfair not to let owner develop in the <br />absence of proposal; and, therefore, would be inclined to continue <br />the item. <br /> <br />Blomquist asked if staff could put together a specific landscaping <br />scheme; Mattila stated the Old Highway 8 Corridor Study touched on <br />that (use the entire northern parcel as a landscaping scheme as a <br />gateway into New Brighton with a small office development on the <br />parcel to the south). <br /> <br />Benke stated all of Robinson's parcel would need to be acquired <br />and Mr. Robinson would need to relocate; Mattila responded affir- <br />matively. <br /> <br />Page 12 <br />
