, <br />vN-1.56 -2- <br />Discussion° <br />The property in_question is considered a building of multiple <br />':occupancy having individual entrances and for purposes of signing <br />is governed by Section l~?-200.. paragraph fc) of the Zoning Code. <br />The above mentioned Section indicates that each occupant may display <br />one individual wall sign while the buildings may be identified <br />by a single ground sign omly, displaying the name of the bu i ding <br />only. The applicant is request~.ng a variance because in this case <br />he wishes to have two ground signs, one. of which is a directory <br />sign. The applicant has an existing ground sign along I-35TnT <br />-and east of the E-Z Mini buildings (see attached drawing of sign). <br />`This existing sign is non-conforming because it exceeds in `size <br />the allowable limits in the sign ordinance. The existing sign <br />is 25 feet in height and is ?08 square feet in area. Code <br />regulations would allow a sign not exceeding 35 in height and 170 <br />square feet in area. In addition, there may be a question cp~hether <br />this.-existing sign identifies the building(s) only or an individual <br />business"i.e.,E-Z Mini Gtorage. <br />In respect to this variance application, we would note that <br />the Council considered a previous application for signs at the <br />.above location at its meeting of September 9, 1975° The action <br />of the Council was as follows: <br />"Motion by Eagon, seconded by Fisher, to find a hardship <br />exists anc~ that the variance is in compliance with the purpose <br />and intent of Chapter HIV of the Zoning Code and to approve <br />VN-1~6 subject to the following conditions: <br />1. That the variance apply to the proposed sign on 5th Wit. <br />NW, signed by the Building and Planning Coordinator and <br />dated 919/75; <br />2. "That such sign on 5th St, be made to 6 panels on each side; <br />3. That such sign on 5th St. be setback 13~ feet from. the <br />property line on 5th Ave.; <br />~< That no variance be granted for the sign on I-35TH]; <br />5. That all other signs on the property be removed with the <br />exception of sma:il wall signs. on the interior of the <br />project that are not legible from 5 h St. or T-35GJ, <br />6. That such variance. to terminate upon subdivision or additiona <br />building or construction on the property; <br />
