J '~' M ~ <br />VN-156 <br />-/.- <br />• In respect to this variance application, we would note. that <br />the Council considered. a previous application for -signs at the <br />above location at its meeting of September 9, 1975. The action <br />of the Council was as follows: <br />"Motion by Eagon, seconded by Fisher, to find a hardship <br />exists and that the variance is in compliance with the purpose <br />and intent of Chaper Y:.IV of the Zoning Code and to approve <br />VN-1~6 subject to the following conditions: <br />1. That the variance <br />Street NW, signed <br />Coordinator and d. <br />2. That such sign on <br />each side; <br />3. That certified excerptU of the minutes be recorded <br />with the property. <br />5 ayes,0 nayes - motion carried" <br />fit the time of this variance approval there was some <br />confusion on the part of the applicant as to the exact meaning <br />of condition #?~. The mover and seconder of the above motion <br />indicated that condition #~ meant that the existing sign along <br />I-35W was to be made to conform. Essentially, this could be <br />accomplished by removing the lower telephone number panel. <br />Informed of the intent of condition number ~!-, the applicant <br />indicated that the telephone number panel had been very instrumental <br />in attracting customers to the property and that they could not <br />• exercise the variance under the conditions applied. The applicant <br />did not exercise the variance within 180 days and as such the <br />variance is now void. The applicant is thus requesting a <br />second. ground sign for the Fifth Street side to the <br />
