VN-165 --2- Nov. 9. 1976 <br />-.The applicant has indicated (see attached applicant's remarks) that ` <br />the variance is requested because a strict and literal interpre- <br />ta_tion and enforcement of the:. zoning ordinance to this proFe rty <br />would not allow the subdivision. The appla,cant has further <br />indicated that itis difficult toapplyplaning regula tionsto <br />this area which was platted in part at various times... :The <br />applicant has also noted that the variance is requested because <br />of the unique circumstances applying to .the property, such as' <br />the-unusual topography, the location of existing structures <br />and 'landparcels, the :parcel's shape,-and the parcel's size. Lastly, <br />the applicant has indicated that the variance would not conflict . <br />with the City's.Comprehensve...Plan:or its zoning code, that the <br />grat6ting of the variance would not be detrimental or: injurious <br />to property or improvements in the neighborhood, that the variance <br />~~rould not impair an adequate supply of light or air to adjacent <br />property, substantially increase traffic or congestion, or increase <br />the danger of fire, or endanger the public safety. <br />In regard to this request, we would comment that the stated intent <br />of the subdivision regulations is to promote and protect the public <br />health, safety and general welfare. It would also appear that the <br />implied intent of the subdivision regulations promotes the orderly. <br />and uniform subdivision of property. In terms of this request, <br />we see potential problems regarding lot Lines and property <br />ownership, annoying conditions resulting from lot line confusion. <br />and from the construction of a house in an area adjacent to the <br />back yards of abutting lots. Property values of adjacent lots <br />may be diminished by construction that may imgair lake views, <br />lessen privacy and perhaps, make rear. yards less desirable in <br />terms of usable open space. There may also be a question of <br />.whether the public safety is being promoted by the subdivision. <br />The new .home constructed would be set well back from the street <br />in an area of lower-elevation surrounded by adjacent homes and <br />trees which may make it difficult for police and fire to locate <br />the property in an emergency. T.t appears three may also be <br />inadequate area for fire trucks to turn around if they must eneter <br />far into Lhe property.- Access from this parcel into Long Lake <br />Road-may also raise a safety concern. Specifically, the construction <br />of an additional driveway would leave three driveways in an area <br />of approximately 40 feet, near- the end of the curve on Lang Lake <br />Road. This may create problems for northbound traffic on Long. <br />Lake .Road and for traffic entering and exiting the subject parcel. <br />The concern for traffic may, however,. be minimal as one additional <br />Ingle family home is notlakely to create an excessive number of <br />daily rips. <br /> <br />
