Walter Baaken, resident in the area, asked if the Department of Natural Resources had been consulted to see if there is a water problem.- Douglas Kessler, resident, spoke in opposition to proposal and asked about a letter that had been the . sent to Mr. Harstad regarding this question from the Rice Creek Watershed District. Mr. Kessler also questioned the filling of the pond. Motion by Janecek, seconded by Biomquist to close Staff prepare hearing. Resolution 5 ayes - 0 Hayes- carried denying Motion by Janecek, seconded by Blomquist to deny variance- Vlti1_184 request and to direct .staff to prepare a resolution listing a findings of fact to include: 1. That the city should not allow the house -- - to be built at the requested elevation because of the potential drainage problems with the storm .sewer system; 2. That there is a possibility of opening the city to problems down the line and because of a possible flooding of basements; 3. That the developer should meet the code; 4. That several residents appeared at the hearing to speak in opposition to this proposal; and 5. That the Rice-Creek Watershed District. has sent a letter expressing concern about this proposal.. 5 ayes - 0 Hayes - carried
