<br />4 <br />Council Proceedings <br />City of New Brighton <br />June 13, 197.8 <br />He felt. that the developer should not have been <br />permitted to go this far but in the future the <br />City will be responsible for anything that. goes wrong. <br />Karen Nyholm, 1589 25th Avenue N.W., stated she <br />felt the houses were too-large for the-lot size. <br />Arnold Rollands agreed with Ms. Nyholm that the <br />houses were too large for the lot size . <br />Joe Pasklo, 1597 26th Avenue, spoke in oppositon <br />to the proposal and stated some basement .floors <br />are at a lower level than the high water level <br />of the lake. <br />Chris Pasklo, 1597 26th Avenue, son of Joe Pasklo, <br />expressed concern about plugging of the culvert. <br />Walter Baaken, resident in the area, asked if the <br />Department of Natural Resources had been consulted <br />to see if there is a water problem.- <br />Douglas Kessler, resident, spoke in opposition to <br />proposal and asked about a letter that had been <br />the <br />. <br />sent to Mr. Harstad regarding this question from <br />the Rice Creek Watershed District. Mr. Kessler <br />also questioned the filling of the pond. <br />Motion by Janecek, seconded by Biomquist to close Staff prepare <br />hearing. <br />Resolution <br />5 ayes - 0 Hayes- carried <br /> denying <br />Motion by Janecek, seconded by Blomquist to deny variance- Vlti1_184 <br />request and to direct .staff to prepare a resolution <br />listing a findings of fact to include: <br />1. That the city should not allow the house <br />-- - to be built at the requested elevation <br />because of the potential drainage problems <br />with the storm .sewer system; <br />2. That there is a possibility of opening the city <br />to problems down the line and because of a <br />possible flooding of basements; <br />3. That the developer should meet the code; <br />4. That several residents appeared at the hearing <br />to speak in opposition to this proposal; and <br />5. That the Rice-Creek Watershed District. has sent <br />a letter expressing concern about this proposal.. <br />5 ayes - 0 Hayes - carried <br />
