<br />Council Meeting Minutes <br />July 28, 1987 <br /> <br />III <br /> <br />Proper asked for an extended warranty on the curb patching and be- <br />lieved a two-year warranty would be an optimum time, giving the <br />city a factor of safety (versus Braun Engineering Testing's recom- <br />mended one-year warranty). <br /> <br />In response to Benke's question about the footprints, Proper indi- <br />cated he witnessed a contractor working on the curb on Fourth Ave- <br />nue and noted the footprints on the curb shortly thereafter; Roger <br />Dalzen, 687 Fourth Avenue N.W., noted the same on Seventh Street. <br /> <br />To clarify the warranty, Proper indicated the contract includes a <br />one-year warranty and he is recommending an additional year, for a <br />total of two years. <br /> <br />Benke asked if aggregate spalls are unique to curbing projects; <br />Norton stated he noticed a matrix deterioration and the aggregate <br />was exposed more than would be the case, noting it is very appar- <br />ent in driveway entrance areas which could be a result of traffic <br />that had to get in and out before the concrete had set up proper- <br />ly; in other areas, the concrete may have gotten wet before it was <br />allowed to set up properly (there were a few areas like that; <br />again at the driveway entrances). Norton indicated this is not <br />extraordinary nor unusual if there had to be traffic. <br /> <br />I <br /> <br />Williams recalled there were some situations where the road was <br />graded in such a way the water was causing a problem in garages <br />and residences. Proper stated two locations were found to have <br />problems because of the recent heavy rains; as they were not the <br />fault of the contractor, the corrections will be completed by the <br />city staff. <br /> <br />Danny Dahms, 675 Fourth Avenue N.W., noted epoxy is already crack- <br />ing and asked what guarantee is in place to have it replaced; <br />Benke stated there are noticeable cracks where the repair was very <br />thin and the area will be corrected in the Spring following the <br />freeze/thaw cycle. <br /> <br />Dahms asked if council should consider a longer warranty; Norton <br />believed, after two years, the city and residents should be able <br />to tell if deterioration is faster than expected and the city <br />could take further action at that time; did not believe a five- <br />year warranty would mean much more than a two-year warranty. <br /> <br />I <br /> <br />As to the question of the pop-outs, Norton indicated the contrac- <br />tor will be responsible for what happens during the time period of <br />two freeze/thaw cycles; there will not be damage to the curb if <br />the epoxy repairs do pop out; and any further repairs would be <br />made before the seal coating three to five years after completion <br />of the project. <br /> <br />In response to Williams1s concern about enforcement, LeFevere <br />stated it would go to litigation but suggested a less expensive <br />alternative for the city would be the requirement of a performance <br />bond. <br /> <br />Blomquist asked that a performance bond be added as a condition; <br />Benke concurred. <br /> <br />Page 3 <br /> <br />-. <br />
