<br />III <br /> <br />I <br /> <br />III <br /> <br />Council Meeting Minutes <br />June 23, 1987 <br /> <br />Brandt stated one of the concerns is the amount of green space <br />lost by doing a zero-lot-line development and noted, to increase <br />density, she would favor a proposal of clustered dwellings. <br /> <br />Blomquist agreed and encouraged Hedlund to come back with a propo- <br />sal for either a cluster development or eight single family homes <br />on the site. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Sinda explained the proposed resolution for posting certain city <br />streets is a follow-up with council's action on June 9, 1987. <br />Sinda noted subsequently we received correspondence from the <br />School District, as provided to council this evening, regarding <br />their response. <br /> <br />Sinda summarized basically the School District has rejected some <br />conditions in the contract and they believe the city does not have <br />jurisdiction over this Special Use Permit and could start con- <br />struction; and, because a meeting has been scheduled between their <br />attorney and our attorney this Thursday to discuss the matter fur- <br />ther, council may wish to defer action on the posting of the <br />signs. <br /> <br />LeFevere indicated School Districtls attorney felt it would be <br />very helpful to him and would be a sign of good faith if this pro- <br />posed resolution were adopted. LeFevere stated he is inclined to <br />think it may be a good idea to adopt the resolution which could be <br />reconsidered at a future date; believes the School District is <br />receiving bids on this project through Friday and understands the <br />Districtls attorney.s position is that they will award the bid, <br />particularly if it appears from the discussion on Thursday that <br />compliance can be reached. <br /> <br />Benke asked if the attorney is the same one who was of the opinion <br />that the District did not have to receive a Special Use Permit; <br />LeFevere stated it was the same attorney. LeFevere was not sure <br />he understood the School Board's position on this but it seems <br />they do not concede the city has the authority to require a condi- <br />tional use permit, but they are willing to sign an agreement pro- <br />viding the terms are acceptable. <br /> <br />Benke stated, based on the tone of the motions adopted by the <br />School Board, he was not quite sure what their perspective is; <br />perhaps they do not have any confidence in their program; suggest- <br />ed the majority of the council discussion was that if the permit <br />system works, it would be illogical to require additional spaces <br />to be constructed. Benke stated now it seems they would rather go <br />to court to tell us we donlt have anything to say about what hap- <br />pens in our city, which is a further justification for the Plan- <br />ning Commissionls and the council 's original perspective. <br /> <br />Page 4 <br /> <br />Posting of Certain <br />City Streets by <br />Irondale High <br />School <br />Report 87-170 <br />
