<br />III <br /> <br />I <br /> <br />III <br /> <br />Council Meeting Minutes <br />June 23, 1987 <br /> <br />Benke suggested staff and attorney maintain cityls stance in their <br />decision; and has confidence the program can work; and stated, <br />because the council and School Board may not be here two years <br />from now, the plan needs to stay in place. <br /> <br />Blomquist felt a way to avoid any discussion in a year from now is <br />to have the parking lots constructed now; Benke stated that is one <br />alternative, but not one he would favor. <br /> <br />Brandt stated in their resolution they are rejecting conditions <br />they suggested (additional space at the Chapel, parking permit <br />system, early afternoon bus) and are putting the city in a posi- <br />tion to sign the streets to regulate parking within the very near <br />proximity of the school, which would merely spread the problem <br />further out to adjacent neighborhoods; and believes the School <br />Board has clearly stated they do not intend to cooperate on this <br />project. <br /> <br />Blomquist asked what the appropriate action would be for the city <br />should the School Board award the bid and begin construction with- <br />out a building permit; LeFevere stated the city would not issue a <br />building permit without a Special Use Permit. <br />LeFevere continued, if construction were started, the city could <br />stop the construction; probably the least spectacular way of solv- <br />ing the issue, if there is an impasse, is to go right into court; <br />and he would hope the School District would try to challenge the <br />city.s action in court rather than proceeding without a building <br />permit. <br /> <br />Benke understands there was a conversation between the Sinda and <br />the School District Superintendent immediately after the council's <br />action two weeks ago; and to his knowledge there has been no fur- <br />ther discussion between the two staffs specifically to the point <br />they had a problem with our proposal. Benke wondered, if they had <br />a problem with the conditions, why didn't they tell us two weeks <br />ago; this lack of communication reinforces the concerns and dif- <br />ficulties the city has had with them for the last nine months. <br /> <br />Blomquist suggested waiting until the meeting on Thursday to take <br />action. <br /> <br />Benke stated if the council does not adopt the resolution, we have <br />to come back later. <br /> <br />Gunderman stated we are faced with passing the resolution or pos- <br />sibly facing a new set of circumstances; Benke stated the council <br />can change the resolution and noted the signs would not go up <br />until Fa 11 . <br /> <br />Because the rules have changed and there may be different consi- <br />derations (ie. maybe we wonlt be signing the streets), Blomquist <br />suggested not taking actio~ at this time. <br /> <br />Page 5 <br />
