That the applicant provide a parking agreement providing for <br />overflow condominium parking on the shopping center property. <br />6. That the acres set aside for public park be between 5 and 5.2 <br />acres and that the appropriate documents be prepared in a form <br />acceptable to the City Attorney for the park dedication. <br />7. That the. single family homes along 29th Avenue be comparable <br />to other single family homes along 29th Avenue N.W. <br />_8. That a Homeowners Association to cover maintenance for the <br />condominium and_ duplexes be established. <br />~- --- - ~ 9~:~~ That the units adjacent to the proposed cul -de-sacs i ncTude ~~_--- -- <br />a mixture of duplexes and townhouses/4-plexes. The ratio to <br />be approximately 30 units in duplex units and 20 units in <br />townhouse./4-plexes. <br />10. That the preliminary plat be amended to provide for the <br />possibility of individual ownership or 1 units per lot. <br />11. That there be a variation in the design of the. duplex unit so <br />that no more than 30% of the duplex units. be of the same- <br />exterior design. <br />i2. That convenants or agreements be provided regarding the use and <br />type:. of pathways for the walkway areas. <br />13. That particular attention in regard to landscapingand buffering <br />be given to the condominium parking area north of Rice Creek <br />~ Road, the area adjacent to the shopping center and- the property <br />adjacent to the existing single family homes on the east side of <br />29th Avenue. <br />14. .That the applicant's submit a letter accepting and agreeing to <br />all conditions of the preliminary PRD approval. <br />Motion by Williams, second by Sande that the conditions be amended to <br />provide for:."15. That the applicant as apart of the final plans to <br />be submitted include a landscaping plan indicating proposed land- <br />scaping of the proposed privately-.owned areas." <br />5 Ayes - 0 Nayes., amendment carried. <br />Motion by Schmidt, second by Livingston to amend the conditions to <br />• include: "16. That the preliminary plan for PRD #27 is recommended <br />for approval contingent on .the approval of variance application <br />VN-206 and plat application, PL-118." <br />5 Ayes - 0 Nayes, amendment carried. <br />Motion by Livinston, second by Williams to amend condition #12 to <br />read: "That convenants or agreements be provided regarding the <br />use and type of pathways for the walkway areas and that said walk- <br />ways except those proposed for th`e park area be constructed by the <br />developer." <br />5 Ayes - 0 Nayes, amendment carried. <br />
