<br />RESOLUTION NO <br />NEW BRIGHTON PLANNING COMMISSION <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />VARIANCE APPLICATION, VN-224 <br />WHEREAS, an application for a variance, VN-224 has been made <br />by the Law Center to construct a second story to an existing <br />commercial building which would result in; and less than the <br />required number of parking spaces; and <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application for a variance, VN-224 was filed with <br />the City on April 6, 1982. <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on April 20, 1982 <br />and May 18, 1982, all person's present at the hearing <br />were given an opportunity to be heard. <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission that <br />the following Findings of Fact are made in respect to VN-224: <br />1. That the property is zoned B-3, General Business; <br />2. That the building is being used as an office requiring <br />one parking space for every 200 square feet of gross <br />floor area; <br />3. That the proposed building addition will result in 6,000 <br />square feet requiring 30 parking spaces; <br />4. That the proposed amended site plan will have 27 parking <br />spaces; <br />5. That the adjoining Super Valu site has informally agreed <br />to allow overflow parking on their site; <br />6. That the parking demand for this building is reduced by <br />the large conference room on the proposed second floor; an( <br />7. That the hardship would result if the applicant could not <br />add on resulting in only developing 30% of their parking <br />and not being given consideration for overflow parking on <br />the Super Valu property. <br />BE IT FURTHER RESOLVED that the application VN-224 is and <br />hereby recommended for approval subject to the following <br />conditions: <br />1. That the site plan depicting 27 parking spaces be complied <br />with and all necessary site work. related to installing <br />27 spaces; <br />2. That parking island landscaping detail be approved by the <br />City Planner. <br />3. That the handicap parking space be relocated and not <br />constructed next to the building. <br />Adopted this day of , 1982. <br />oger S. Williams, Uhairman
