RESOLUTION N0.
RIEW BRIGHTON PLANNING COMMISSION
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF
VN-242.
WHEREAS, an application for a variance has-been made by
Mike Rasmusson and Don Dickison; and
.WHEREAS, the procedural history of the application is as
follows:
1. That an application for a variance was filed
with the .City on May 5, 1985.
2. That the Planning Commission, pursuant to published
and mailed notices, held a public hearing on May 21,
1985, all person's present at the hearing were given
an opportunity to be heard.
-NOW THEREFORE BE IT RESOLVED by the Planning Commission that
th.e following Findings of Fact are made in respect to VN-242:
1. That the required side street yard setback from
lst Street SW is 60-feet.
2. That the applicant is requesting a 20-foot variance
to allow a 40-foot building setback on 1st Street SW.
3. That there exists the following unique and unusual
circumstances, unique to the property, that hinder
development of the site without the requested variance:
a. The eastern property line of the site is the
centerline of County Ditch #2 which. reduces the
buildable area of the site.
b. The site is bordered by County roads on two sides
requiring additional land for building setbacks,
again reducing the buildable area of the site.
c. The triangular shape of the property is unusual and
reduces the possible number of building layouts.
d. That both County road right-of-ways are larger
than the standard street right-of-ways of 60-feet
(1st Street NW is 80-feet and Old Highway 8 is 89.5
feet).
4. That the 20-foot variance will not impact residential
homes on the north side of lst Street SW because of
the large right-of-way and vehicle traffic and parking
will be kept to the rear of the proposed development.
BE IT FURTHER RESOLVED that the application UN-242 is and
hereby recommended for approval subject to the following
conditions:
1. Approval of LP-179.
Adopted this 2lst day of May, 1985.
Roger S. Williams, Chairman
Bren a Krueger, .,ty anner
