VN-2.43 <br />August 16, 1985 <br />Page 2 <br />APPLICANT'S RESPONSE <br />I.n t .e. at ach.e_d letter th.e appl i.cant states that since they moved <br />into their building one year ago they have discovered additional hard- <br />ships which th.e.y feel would warrant reconsideration of their variance <br />request. The applicant states the. area enclosed by the fence is badly <br />needed for snow storage. in the winter, which they had not realized <br />previously.. Th.e applicant also stresses the large right-of-way along <br />Old Highway ,8 which has the fence setback over 50 feet from the curb, <br />the adjacent re.sidenti_al land uses and PCA's request to use the well <br />(..located in th.e northwest corner of the site) as a monitori.ng well. <br />STAFF ANALYSIS <br />As ack.ground information the applicant's. building was approved for <br />construction on April 10, 1984 under LP-156. The approved site plans <br />had the. fence. located in th_e correct location, in line with the front <br />of the building, The applicant changed the location of the fence upon <br />completion of th.e building. When informed by staff the fence would <br />have to be. moved the applicant decided on the alternative and applied <br />for a variance, The variance request was for the fence both north of <br />th.e building and south of the southern most driveway. <br />The applicant has identified the following circumstances they feel <br />warrant a variance. <br />1. To protect themselves against possible injury of <br />unauthorized persons on their property, primarily <br />from the two single family homes to the south and <br />one single family home to the north. <br />2. To protect the existing well on the northwest corner <br />of the site and permit the PCA to monitor the well. <br />3. The need for the area enclosed by the fence to be <br />used for snow storage. There are few snow storage <br />alternatives for.that area north of the building. <br />Snow storage in the ponding area is difficult because <br />the snow plows get stuck if they go too far down into <br />the parking area. <br />4. The large right-of-way along old Highway 8 which has <br />the fence located over 50-feet from the curb. <br />The staff's response to each of the four items identified by the <br />applicant are as follows: <br />1. The area in which the applicant's building is located <br />is zoned industrial, including.the nearby single family <br />homes. Although these few homes remain in the area the <br />area is primarily made up of industrial uses. The home <br />to the north of Thermo-King is now used as a business. <br />As stated in the 1984 staff report the existing homes <br />do not create undue hardship (ability to use the land <br />or operate a business on the property). The driveway <br />entrances have wide visibility, excellent for incoming <br />and outgoing vehicles. The distance of the southern <br />driveway from the property line of the first home south
