MEMORANDUM <br />• TO: Maury Anderson <br />FROM: Betsy Moran <br />RE: Long Lake Park Title Work <br />DA~l'E : November 17 , 19 8 2 <br />The following is a description of the title work which had to be <br />performed relative to Long Lake Park. <br />All but a few of the Long Lake Park parcels were acquired in a <br />condemnation proceeding commenced in 1969. The property descriptions <br />used in the condemnation action were probably taken from old deeds <br />in the chain of_ title. These property descriptions were quite long <br />and particularly complex around the Minnesota Transfer Railway <br />right-of-way which is the eastern boundary of Long Lake Park. Many <br />of the descriptions included references to leases and easements <br />executed .in the early 1900s. <br />l.~ccausc~ of the length and complexity of the legal descriptions, it. <br />has been necessary for our office and the county attorney's office, <br />to trace the history of the legal descriptions. This involved <br />examination of the underlying plats and documents and consultation <br />• with surveyors to determine precisely where the ,parcels are located. <br />It was also necessary to refer to the underlying right-of-way <br />documents for the Minnesota Transfer Railway because the width of <br />the right-of-way varies along the eastern border of Long Lake Park. <br />Further, the City had good title to only 4 of the 14 parcels which <br />make up Long Lake Park. Corrective measures were needed to <br />establish record ownership in the City. <br />finally, it was necessary to reconstruct the 1969 condemnation <br />proceedings because Final Certificates had not been filed against <br />the properties. The District Court file relating to the condemnation <br />was reviewed and Final Certificates were prepared and filed. <br />Before the property is conveyed to the County, one remaining <br />parcel which lies in the central portion of the lake bottom must be <br />traced. This parcel was conveyed to the City by the State on March <br />3, 1978, but it appears that the conveyance was never recorded. <br />lm <br /> <br />
