Easement A regiment for utilit ,trail and road crossin of <br />nnesota rans er a wa.Y ompany r g t-o -way__~nc u. es <br />Home Gas and Walburn LtCI. <br />The easement agreement with the Railway Company will be <br />submitted for approval to the Public Works Committee and <br />County Board at their meetings on February 11th. <br />Staff will be meeting with the General Manager of Home <br />Gas and Vice President of Texgas (parent corporation) <br />during the week of February 4, to review the County's <br />purchase offer and discuss same concerns that were expressed <br />in earlier correspondence from Home Gas Company. <br />The Department has received a letter from the Minnesota <br />Pollution Control Agency stating that the proposed sanitary <br />sewer connection should not adversely impact the New <br />Brighton/Arden Hills ground water investigation currently <br />being conducted by M.P.C.A. Consequently, the County <br />Attorney's office has resumed negotiations with Walburn. Ltd. <br />B. Pipeline Site Intrusion (Williams Pipeline Company) <br />The Gounty Attorney's office met individually with the County <br />Board members who had expressed reservations about specific <br />sections of the draft agreement. After further review of the <br />draft agreement, it was detet"mined that the primary point of <br />contention. was the section which specified the minimum depth <br />to which the pipeline would be lowered.. (Williams initially <br />had specified a depth that was less than permitted by state <br />statute.) The County Attorney's office resumed negotiations <br />and obtained concurrence from the Williams Pipeline Company. <br />The amended draft agreement will be submitted far approval <br />to the Public Works Committee and County Board at their <br />
