Property <br />owners can maintain the ditch area if they wish. <br />Anderson said he spoke with Mr. Deters and the above comment <br />seemed to satisfy him. <br />D. Silver Oak Tennis Court Update <br />When St. Anthony sold Silver Oak School, the developer said <br />there would be two phases of development. Phase I were condos <br />and phase II townhouses. The developer agreed to move the <br />tennis courts at his expense when the townhouses were built. <br />The townhouses were not built, therefore the tennis courts were <br />not moved. <br />Anderson said he had the City Attorney checking into the <br />agreement to see if he could find a loophole in the agreement <br />that would. force the developer to move the tennis courts. <br />The City Attorney could not find anything. <br />Anderson said the attorney has drawn up a document <br />where the city would lease the area surrounding the tennis <br />courts from him. We will accept liability and add four parking <br />spaces. He can cancel the agreement at any time. <br />MOTION BY VAN HATTEN, SECONDED BY BLOMQUIST, TO REQUEST THE <br />CITY COUNCIL TO APPROVE THE AGREEMENT. MOTION CARRIED. <br />V. New Business <br />A. 1988-92 CIP <br />Anderson gave the Park Board a list of the 5 year CIP. <br />Anderson said the council wanted Freedom athletic field in <br />1988. Anderson recommends that all. the Freedom work be done <br />at one time because it is cheaper that way. <br />v <br />
