<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />March 25, 1986 <br /> <br />Council Business, continued <br /> <br />Gunderman questioned the responsibility of clean-up; Schmidt also <br />expressed concern for the lack of city-required licenses. <br /> <br />Gunderman would like communication from the church before council <br />takes action on this item; Benke stated the ordinance would only <br />permit the city to grant a special use permit for the purpose of <br />operating a farmers market, and felt that type of communication <br />would be needed at the time of the application for the special <br />use permit. <br /> <br />Schmidt stated that, as this ordinance amendment is written, <br />there is very little control over the operation of the market <br />once we grant a special use permit, and asked if all the <br />conditions would be included in the permit or if that should be <br />done through the ordinance. <br /> <br />Krueger stated the appearance of the site could be addressed <br />through either the ordinance or as a condition of the special use <br />permit, and noted the difficultly in gauging the impact of an <br />ordinance of this type. <br /> <br />Brandt asked how the city could prevent a flea market from <br />happening; Krueger stated she would walk through a farmers market <br />on occasion and, if anything outside ordinance guidelines were <br />taking place, she would order those items be removed. If it were <br />an on-going problem, she would come back to council asking for a <br />revocation of the special use permit. <br /> <br />Benke stated our Sanitarian would not be involved because the <br />food would not be consumed on the premises; Krueger confirmed <br />that statement, but will check with Dave Fridgen, Sanitarian, <br />regarding the possibility of consumption on the premises. <br /> <br />Williams asked staff to seriously consider the wisdom of <br />including the provision that deals with the length of time the <br />site can be occupied with any type of equipment, feeling there <br />should be a limited time before the market opens for set up and <br />after it closes for removing everything and cleaning up. <br /> <br />Brandt felt it would be a good idea to contact the people at St. <br />John's church who have had some experience with the farmers <br />market, sending them a copy of the proposal and asking them to <br />respond with any suggestions or concerns they may have. <br /> <br />Motion by Benke, seconded by Williams, to WAIVE THE READING AND <br />HOLD THE FIRST READING OF AN ORDINANCE AMENDMENT, INCLUDING THE <br />LANGUAGE CHANGES SUGGESTED BY THE CITY ATTORNEY, PERMITTING THE <br />OPERATION OF A FARMERS MARKET IN A RESIDENTIAL ZONE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Page Nineteen <br />
