<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 25, 1986 <br /> <br />Council Business, continued <br /> <br />Kelley reviewed the staff report concerning an ordinace amendment <br />to allow Sunday liquor sales by clubs, and indicated that, <br />because the state statutes permit the sale of intoxicating liquor <br />on Sunday and the City's ordinance does not include "Clubs," <br />there is a lack of harmony between the two. Kelley stated the <br />Eagles Club, which does hold an on-sale club license, are inter- <br />ested in extending their license to Sunday liquor sales. <br /> <br />Benke asked if food sales are treated the same way with a club; <br />Kelley indicated they are governed by the same percentage and <br />feels the Eagles Club can maintain the standards. <br /> <br />Schmidt recalled the state law was changed from 12:00 Noon; <br />Kelley stated the state passed permissive legislation allowing <br />for cities at local option, to move from Noon to 10:00 a.m. on <br />Sunday, which was brought to council over three years ago at <br />which time council denied the option. <br /> <br />Schmidt asked LeFevere if he was aware of any other legislation <br />which impacts Sunday liquor sales; LeFevere was not aware of any <br />new legislation, but would check. <br /> <br />Larry Karlen, 173 Windsor Court, Chairman of the Trustees of the <br />New Brighton Eagles, felt the lack of change in the ordinance <br />was an oversight; noted the Eagles Club's major functions are on <br />Saturday and Sunday, and would like to operate with a Sunday <br />license as soon as possible. <br /> <br />Williams asked Karlen for clarification that the Eagles Club <br />would be able to meet the meal requirements; Karlen stated they <br />have meals in-house on Sunday and felt confident they would meet <br />the meal requirement. <br /> <br />Schmidt commented that no liquor license establishment in the <br />City have given us a problem, especially the Eagles Club; Kelley <br />confirmed. <br /> <br />Motion by Williams, seconded by Schmidt, to WAIVE THE READING, <br />HOLD THE FIRST READING, OF AN ORDINANCE AMENDING SECTION 4-96(1) <br />OF THE NEW BRIGHTON CITY CODE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Winkels reviewed the staff report concerning a resolution <br />setting zoning and platting fees. <br /> <br />Benke asked if we could put into effect a variable fee schedule; <br />Winkels indicated that a variable fee schedule is not well <br />received from those making applications in the two suburbs of <br />which he was aware had that type of schedule, and felt a varia- <br />ble fee schedule could be counter-productive. <br /> <br />Page Five <br /> <br />Ordinance Amendment - <br />Sunday Liquor Sales <br />First Reading <br />Report 86-44 <br /> <br />Zoning and Platting <br />Fees <br />Report 86-45 <br />Resolution 86-12 <br />
