<br />I <br /> <br />I <br /> <br />~ I <br />! <br />{ <br />i <br />t <br />, <br />.f_ <br /> <br />Council Meeting Minutes <br />September 24, 1985 <br /> <br />Following a discussion of possible sites in New Brighton, motion <br />by Schmidt, seconded by Blomquist, to WAIVE THE READING AND ADOPT <br />THE PROPOSED RESOLUTION MAKING FINDINGS OF FACT AND DENYING A <br />REQUEST TO OPERATE A FAffi~ERS' MARKET IN AN R-l, SINGLE FAMILY <br />ZONING. <br /> <br />Motion by Harcus, seconded by Janecek, to amend the motion, <br />adding TO DIRECT STAFF TO WORK WITH APPLICANT TO FIND ALTERNATIVE <br />SITES THAT WOULD BE PERMISSIBLE. <br /> <br />5 Ayes 0 Nayes, Amendment Carried <br />5 Ayes - 0 Nayes, Main Motion Carried as Amended <br /> <br />Motion by Benke, seconded by Harcus, to REQUEST THE PLANNING <br />COMMISSION TO CONSIDER WHETHER OR NOT AND/OR UNDER WHAT CONDITIONS <br />A FARMERS I t1ARKET TYPE OF BUSINESS MIGHT BE PERMITTED IN PARKING <br />LOT SITUATIONS IN R-l DISTRICTS, IDENTIFYING CONTROLS AND CON- <br />CERNS (can the code be modified in certain circumstances). <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Winkels reviewed staff report and the basics of the Development <br />Agreement, distributed a Cash Flow Analysis in draft form, and <br />stated that Dennis Doyle, president of Welsh Companies, had <br />indicated that his attorney had not had time to review the Agree- <br />ment. <br /> <br />Doyle stated he had received a draft of the Agreement last week, <br />however, because his attorney had been out of town, it is not <br />signed and completed; Doyle has contacted O'Connor & Hannon and <br />they have agreed substantially with all of the issues involved <br />in the Agreement and stated that the only situation that exists <br />is that it hasn't been redrafted and presented in execution form. <br /> <br />Doyle explained that. because Welsh Companies is moving at such <br />a rapid pace to have groundbreaking early in November, permanent <br />financing will not be in place but that the company's cash and a <br />Letter of Credit from the bank will be in place. <br /> <br />Blomquist asked about the Purchase Agreement; Wi1kels explained <br />that it is contained in the Development Agreement. <br /> <br />Schmidt asked if the process is moving forward and the timetable <br />wi 11 be hi ndered by a two-week del ay; Doyl e responded that agree- <br />ment has been reached with all financing. <br /> <br />Doyle confirmed that Welsh Companies is not negotiating any <br />assistance. <br /> <br />Motion by Blomquist, seconded by Janecek, to DEFER THE ACTION TO <br />AUTHORIZE A CONTRACT FOR PRIVATE DEVELOPMENT BY AND BETWEEN THE <br />CITY OF NEW BRIGHTON AND WELSH COMPANIES, INC.
