<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Mi nutes <br />May 28. 1985 <br /> <br />May stated that Tom Thumb believes the store demonstrates <br />a need for buying goods and services; doesn't believe there <br />will be an increase of traffic or any safety hazards; and <br />wants to provide the additional service of gasoline. <br /> <br />Proper feels the driveway could be aligned with the street; <br />doesn't believe there will be that much cross-traffic, but <br />feels they should be aligned; and would like to look at the <br />site problems again, <br /> <br />In response to Janecek's question concerning the timing of <br />this application, Kreuger responded that there are two <br />alternatives: resubmit the application through the Planning <br />Commission; or to pass a motion to reconsider last month's <br />motion and then entertain a new motion to send it back to <br />the Planning Commission which would alleviate having to <br />apply for a special-use permit. <br /> <br />Blomquist asked what the advantage would be to Tom Thumb of <br />not reapplying for a special-use permit; Krueger indicated <br />it would not matter. <br /> <br />Motion by Blomquist. seconded by Janecek, to RECONSIDER <br />THE MOTION OF MAY 14, 1985. TO DENY A SPECIAL-USE PERMIT <br />APPLICATION FOR TOM THUMB, <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Motion by Blomquist, seconded by Harcus, to REFER THE APPLI- <br />CATION FOR A SPECIAL-USE PERMIT FOR TOM THUMB BACK TO THE <br />PLANNING COMMISSION FOR CONSIDERATION OF A NEW APPLICATION, <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Harcus indicated the City Attorney recommended that the City <br />of New Brighton officially notify New Brighton Rent-All of a <br />hearing to revocate the license for New Brighton Rent-All <br />and, therefore, this matter should be continued at the next <br />counc iT mee t i ng . <br /> <br />LeFevere indicated there would be a legal notice sent to the <br />applicant that a hearing will be held. he has a right to <br />be represented by counsel. and that he has a right to present <br />evidence along with witnesses; this being done in the absence <br />of a formal procedure in the zoning code for revoking licenses, <br /> <br />Motion by Janecek, seconded by Blomquist. to SET A HEARING. <br />ON THE ~EW BRIGHTON RENT-ALL LICENSE REVOCATION FOR JUNE 11, <br />1985, AT 7:40 P.M, IN ORDER THAT PROPER NOTIFICATION BE <br />GIVEN TO THE LICENSEE. <br /> <br />4 Ayes - 0 Nayes.
