<br />Council Minutes <br />February 26, 1985 <br /> <br />I <br /> <br />Schmidt felt economics would drive price down so that they <br />are filled, rather than empty. <br /> <br />In response to Janecek's question, Senden stated that cars <br />entering from Palmer Drive could exit on the south side only <br />through the garage. <br /> <br />In response to Janecek's concern for entry by the Fire De- <br />partment, Buxsell indicated that the emergency exit onto <br />Thorndale would be maintained. <br /> <br />In response to Benke's question concerning congestion on <br />visiting days, Senden responded that an agreement could be <br />worked out with First State Bank of New Brighton. Benke <br />commented he would prefer an agreement rather than having <br />additional parking space installed for overflow situations. <br /> <br />Blomquist indicated that the definition of subsidized <br />housing and whether or not, in the original approval, there <br />had been any concessions given to the neighborhood (such as <br />"the zoning would not be changed") were two concerns of the <br />Planning Commission. <br /> <br />I <br /> <br />City Attorney LeFevere stated the concern was that subsi- <br />dized housing meant Section 8 (direct subsidy); felt the <br />kind of assistance contemplated here by the Minnesota <br />Housing Finance Agency's financing for the project, which will <br />require that 20% of the housing be for people at 80% of the <br />median income or less, would be meeting the HUD requirements. <br />Feels this is sufficient assistance within the meaning of the <br />code. There is nothinq in the code to suggest that 100% of <br />the housing be designated for low income people, however, <br />under the PRO requirements, 1005~ of the housing facility <br />should be elderly. <br /> <br />LeFevere felt that, although the code doesn't say it, it <br />doesn't have to be 100% low income and, although it doesn't <br />say it, it does have to be 100~ elderly. <br /> <br />LeFevere expressed concern of the ordinance itself, how en- <br />forceable it would be to restrict someone under the age of <br />50 from moving into the project. LeFevere stated his con- <br />cern is not for this project and feels this project qualifies <br />for the density credit. <br /> <br />I <br /> <br />Schmidt stated he felt very comfortable with this project; the <br />neighborhood has been well-represented on issues in the past <br />but there was no representation here toni9ht, which is an <br />indication that the development has served the neighborhood <br />well. <br /> <br />Blomquist stated he had asked Krueger to pull minutes of the <br />council and planning commission pertaining to the first phase <br />of this project; stated he was unable to identify anything <br />that suggested any limits on rezoning or number of units, <br />either explicit or implied, in any of the language used at <br />any of the meetings. <br /> <br />Page Four <br />
