HEDLUND'S <br />REQUEST TO PURCHASE THE THIRTY FEET OF VACATED RIGHT-OF- <br />WAY BE DENIED BASED ON PAST POLICY NOT TO SELL OFF PARK <br />LAND TO PRIVATE PROPERTY OWNERS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Kelley reviewed staff report concerning the application <br />for a transient merchant license, pointing out that the <br />City could not legitimately deny the request based on <br />the objection of Satin Bow Florists in Rice Creek Center. <br /> <br />Schmidt indicated that Rice Creek Road and Silver Lake <br />Road are heavily trafficked and abrupt stopping of cars <br />would be a danger for following vehicles. <br /> <br />In response to Benke's inquiry, Kelley indicated that he <br />didn't have information available to indicate there had <br />been traffic problems when Green Stem Floral sold flowers <br />on the same corner prior to Easter. <br /> <br />In response to Benke's question, Schmidt indicated he <br />felt that curbside sales in any location creates traffic <br />distraction, and distraction is a cause for accidents. <br /> <br />Motion by Schmidt, seconded by Janecek, to DENY GREEN <br />STEM FLORAL'S APPLICATION FOR A TRANSIENT MERCHANT'S <br />LICENSE BASED ON POTENTIAL TRAFFIC-RELATED PROBLEMS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Kelley reviewed staff report concerning Blue Bell Ice <br />Cream, Inc.'s application for a peddler's license, <br />recommending denial of application based on Ordinance <br />Section 20-3 prohibiting the use of bells to attract <br />customers. <br /> <br />Benke asked if Kelley would have a problem if "ringing <br />a bell" was not included in Ordinance Section 20-3. <br />Kelly responded he would have no professional objection. <br /> <br />Schmidt sees this license as an attractive nuisance <br />which creates danger. <br /> <br />Motion by Schmidt, seconded by Blomquist, to deny Blue <br />Bell Ice Cream, Inc.'s application for peddler's <br />license. <br /> <br />Benke stated he finds it hard to believe that if there <br />is such danger the activity hasn't been banned across <br />the country and would favor tabling the request in order <br />to review the ordinance section for the possible removal <br />of "ringing a bell."
