FOR A PEDDLER'S <br />LICENSE AND DIRECT STAFF TO DRAFT AND REFER TO THE <br />CITIZEN STUDY COMMITTEE FOR CONSIDERATION AN ORDINANCE <br />AMENDMENT THAT WOULD DELETE THE PROHIBITION AGAINST THE <br />USE OF BELLS TO ATTRACT CUSTOMERS (ORDINANCE SECTION <br />20-3). <br /> <br />4 Ayes - 1 Nay (Schmidt), Motion Carried <br /> <br />Winkels reviewed staff report concerning the request of <br />John Schul ties for special permission to have a setback <br />on his corner lot. Winkels further stated that staff <br />could see no problem with the request, and indicated <br />Mr. Schul ties was in the audience to answer any questions <br />of Council. <br /> <br />Motion by Janecek, seconded by Benke, to GRANT SPECIAL <br />PERMISSION TO CONSTRUCT A HOME ON LOT 22, BLOCK 3, <br />INNSBRUCK NORTH, NEW BRIGHTON SECOND ADDITION, WITH A <br />THIRTY (30) FOOT SETBACK ON 29TH AVENUE NW AND A TWENTY <br />(20) FOOT SETBACK ON 13A STREET NE, SUBJECT TO THE CON- <br />DITION THAT THE SETBACK OF THE GARAGE FROM l3A STREET NW <br />BE A MINIMUM OF TWENTY-SIX (26) FEET. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Winkels reviewed staff report concerning a Purchase <br />Agreement received from Robert F. Kallestad for <br />City property located at the southeast corner of Fifth <br />Avenue NW and Fifth Street NW (County Road E2). He <br />further noted that the City Attorney had expressed <br />some concerns with the purchase agreement, but the <br />concerns could be resolved by putting the whole pack- <br />age into our Development Agreement. <br /> <br />LeFevere stated that if it would be easier to amend the <br />Purchase Agreement at a later date, rather than handling <br />the concerns through a Development Agreement, Council <br />could authorize execution of the Purchase Agreement <br />subject to approval of the City Attorney and the City <br />Manager. <br /> <br />Motion by Blomquist, seconded by Harcus, to AUTHORIZE THE <br />MAYOR AND THE CITY MANAGER TO EXECUTE A PURCHASE AGREE- <br />MENT BETWEEN ROBERT F.
